This Purchase Order is issued for the procurement of specialized Biomedical Engineer professional services to be rendered at the Cape Town Metropolitan Health Services facility located in South Africa Cape Town. The Biomedical Engineer engaged under this Purchase Order shall be responsible for the installation, calibration, preventive maintenance, troubleshooting, and regulatory compliance of all medical and diagnostic equipment within the facility. The Biomedical Engineer must hold a valid South African Council for Professional Engineers (SACE) registration and a minimum of five (5) years of post-qualification experience in hospital-grade biomedical engineering.

All services under this Purchase Order shall be performed at the Cape Town Metropolitan Health Services main facility and its satellite clinics within the South Africa Cape Town metropolitan area. The Biomedical Engineer shall report to the Clinical Engineering Division office at 124 Bree Street, Cape Town Central, on a full-time basis during contracted hours (Monday to Friday, 07:00 to 17:00). Emergency call-out services shall be available 24 hours per day, 7 days per week, with a maximum response time of two (2) hours for critical life-support equipment failures within the South Africa Cape Town metro area.
- This Purchase Order constitutes a binding agreement between the Purchasing Entity and the Supplier upon signature by both parties. All terms herein are governed by the laws of the Republic of South Africa.
- The Biomedical Engineer assigned to this Purchase Order must maintain valid professional registration with the South African Council for Professional Engineers (SACE) and the Health Professions Council of South Africa (HPCSA) for the entire duration of the contract. Failure to maintain registration shall constitute grounds for immediate termination of this Purchase Order.
- Payment shall be made within thirty (30) calendar days of receipt of a valid tax invoice. Invoices must reference this Purchase Order number (PO-2025-CT-04872) and include the Supplier's VAT registration number.
- The Biomedical Engineer shall comply with all applicable South African legislation, including the National Health Act (Act 61 of 2003), the Medical Devices Act (Act 101 of 2003), and the Occupational Health and Safety Act (Act 85 of 1993).
- All work performed by the Biomedical Engineer at the South Africa Cape Town facility shall be subject to quality assurance review by the Purchasing Entity's Clinical Engineering Division. Non-conforming work must be rectified at the Supplier's own cost within five (5) business days.
- The Supplier warrants that the Biomedical Engineer shall carry professional indemnity insurance of no less than ZAR 5,000,000.00 for the duration of this Purchase Order. A certificate of insurance shall be provided prior to commencement of services.
- Confidentiality: The Biomedical Engineer shall treat all patient data, facility operational information, and proprietary equipment specifications as strictly confidential in accordance with the Protection of Personal Information Act (POPIA, Act 4 of 2013).
- This Purchase Order may be terminated by either party with thirty (30) days' written notice. In the event of termination, the Supplier shall be compensated for services rendered up to the effective date of termination.
- Any disputes arising from this Purchase Order shall be resolved through mediation in Cape Town, South Africa, in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA).
- The Supplier shall not subcontract any portion of the Biomedical Engineer services without prior written consent from the Purchasing Entity.
