- This Purchase Order constitutes a binding agreement between Southern Cross Hospitality Group Pty Ltd (hereinafter "the Buyer") and Brisbane Culinary Talent Solutions Ltd (hereinafter "the Supplier") for the engagement and provision of Chef services as described herein.
- The Chef engaged under this Purchase Order must hold a valid Australian working visa or permanent residency, a current Food Safety Supervisor certificate recognised in Queensland, and a National Police Check with no disqualifying offences.
- All services shall be performed at the designated premises located in Brisbane, Queensland, Australia, or at such other locations within the Greater Brisbane metropolitan area as mutually agreed in writing.
- The Chef shall comply with all applicable Australian employment law, including the Fair Work Act 2009 (Cth), the Queensland Industrial Relations Act 2016, and the relevant Australian Manufacturing and Hospitality Award conditions.
- The Supplier warrants that the Chef shall maintain professional indemnity insurance with a minimum cover of AUD 5,000,000 and public liability insurance of AUD 10,000,000 throughout the duration of this Purchase Order.
- Any variation to the scope of Chef services, additional event bookings, or changes to the Brisbane work location must be documented in a written variation to this Purchase Order and signed by both parties before execution.
- The Buyer reserves the right to terminate this Purchase Order with 30 days written notice if the Chef fails to meet the performance standards outlined in the attached Service Level Agreement, or if any breach of Australian food safety or workplace health and safety legislation occurs.
- All intellectual property, including proprietary recipes, menu designs, and culinary techniques developed by the Chef during the term of this Purchase Order, shall remain the sole property of the Buyer.
- Disputes arising from this Purchase Order shall be resolved in accordance with the laws of the State of Queensland, Australia, and shall be subject to the exclusive jurisdiction of the courts of Brisbane, Queensland.
- This Purchase Order is governed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) and the Queensland Fair Trading Act 1989.
By signing below, both parties acknowledge and agree to the terms, conditions, and scope of work set forth in this Purchase Order for the Chef engagement in Australia Brisbane. This document is valid for acceptance within 14 calendar days of the issue date.
