4.1 This Purchase Order is issued in accordance with the labour laws of the Republic of South Africa, including the Basic Conditions of Employment Act (Act 75 of 1997) and the Labour Relations Act (Act 66 of 1995), as applicable to all Chef personnel engaged in Johannesburg.
4.2 All Chef positions listed in this Purchase Order shall commence no later than 1 August 2025 at the designated Johannesburg, South Africa premises. The Supplier shall ensure that all Chef candidates have completed the required onboarding, health and safety induction, and food hygiene certification prior to their first day of service.
4.3 The Supplier warrants that all Chef personnel supplied under this Purchase Order hold valid South African work permits or permanent residency where applicable, and that all Chef candidates have undergone comprehensive criminal background checks, reference verification, and culinary skill assessments conducted within the Johannesburg metropolitan area.
4.4 Payment for this Purchase Order shall be made within thirty (30) calendar days of receipt of a valid tax invoice from the Supplier. Payment shall be made via electronic funds transfer (EFT) to the Supplier's designated bank account in South Africa.
4.5 The Buyer reserves the right to terminate any individual Chef position listed in this Purchase Order with thirty (30) days' written notice, in which case the Supplier shall refund a pro-rata portion of the annual fee for the terminated Chef position, less any non-recoverable recruitment costs already incurred.
4.6 All Chef personnel engaged under this Purchase Order shall be subject to the Buyer's internal policies, health and safety regulations, and the South African National Food Safety Authority (NASF) guidelines applicable to food service establishments in Johannesburg.
4.7 This Purchase Order is governed by the laws of the Republic of South Africa. Any disputes arising from this Purchase Order shall be subject to the jurisdiction of the Magistrate's Court in Johannesburg, South Africa.
Important Note: This Purchase Order for Chef services is specific to the Johannesburg, South Africa operating location. All Chef personnel must be physically present and resident in the Johannesburg metropolitan area to commence duties. The Supplier is responsible for ensuring compliance with all local municipal by-laws regarding food preparation and kitchen operations in the City of Johannesburg. 5.
