This Purchase Order is issued by Atlantic Coastal Infrastructure Projects (Pty) Ltd to engage the services of a qualified Civil Engineer and associated design team for the planning, design, and structural assessment of the Atlantic Seaboard Stormwater Drainage Upgrade Project situated in South Africa Cape Town. The Civil Engineer shall be responsible for all structural calculations, hydraulic modelling, geotechnical review, and compliance with the National Building Regulations (NBR) as applicable in the Western Cape Province. The scope of work encompasses the full engineering lifecycle from feasibility studies through to as-built documentation for the designated project area along the Atlantic coastline of Cape Town.

The Civil Engineer shall mobilise to the project site in South Africa Cape Town within fourteen (14) calendar days of the acceptance of this Purchase Order. The feasibility study and hydraulic modelling (Items 01 and 02) shall be delivered within sixty (60) days. Structural design documentation (Items 03 and 04) shall be submitted for client review within one hundred and twenty (120) days. Construction supervision (Item 05) shall commence upon issuance of the construction permit by the City of Cape Town and shall continue until practical completion. All as-built documentation (Item 06) shall be submitted within thirty (30) days of project completion.

  • 5.1 This Purchase Order is governed by the laws of the Republic of South Africa. Any disputes arising from this Purchase Order shall be subject to the jurisdiction of the High Court of South Africa, Cape Town Division.
  • 5.2 The Civil Engineer warrants that all professional services shall be rendered in accordance with the SAICE Code of Professional Conduct and the National Building Regulations (Act 103 of 1977, as amended).
  • 5.3 Payment shall be made within thirty (30) days of receipt of a valid tax invoice. Invoices must reference this Purchase Order number (PO-2025-CT-00482) and the applicable line item.
  • 5.4 The Civil Engineer shall maintain professional indemnity insurance of no less than R5,000,000.00 for the duration of the engagement in South Africa Cape Town.
  • 5.5 All intellectual property, design drawings, and engineering calculations produced under this Purchase Order shall become the sole property of Atlantic Coastal Infrastructure Projects (Pty) Ltd upon full payment.
  • 5.6 The Civil Engineer shall comply with all applicable health, safety, and environmental legislation, including the Occupational Health and Safety Act (Act 85 of 1993) and the National Environmental Management Act (Act 107 of 1998).
  • 5.7 Any variation to the scope of work must be agreed in writing via a formal variation order signed by both parties before additional work is commenced.
  • 5.8 This Purchase Order may be terminated by either party with thirty (30) days written notice. In the event of termination, the Civil Engineer shall be compensated for all services rendered up to the date of termination.
  • 5.9 The Civil Engineer shall submit a monthly progress report to the client detailing work completed, upcoming milestones, and any risks or delays affecting the project timeline in South Africa Cape Town.
  • 5.10 Late delivery of any deliverable beyond the agreed schedule shall attract a liquidated damages penalty of 0.5% of the applicable line item value per calendar day, capped at 10% of that line item value.

This Purchase Order constitutes a binding offer for the Civil Engineer services described herein. By signing below, both parties acknowledge and agree to the terms, conditions, scope of work, and pricing set out in this document. This Purchase Order is valid for acceptance until 14 July 2025, after which it shall lapse unless renewed in writing.
