This Purchase Order is issued to procure the professional services of a qualified Environmental Engineer to conduct comprehensive environmental impact assessments, compliance audits, and remediation planning for the Cape Town Metropolitan Environmental Authority. The Environmental Engineer shall operate within the jurisdiction of South Africa Cape Town, adhering to all applicable national and provincial environmental legislation, including the National Environmental Management Act (NEMA) 107 of 1998, the Western Cape Environmental Management Act, and the relevant regulations promulgated under the Department of Forestry, Fisheries and the Environment.

  1. Compliance with Legislation: The Environmental Engineer and all sub-consultants engaged under this Purchase Order shall comply with all South African environmental legislation, including NEMA, the National Water Act 36 of 1998, the Waste Act 59 of 2008, and all applicable Western Cape provincial by-laws governing environmental management in Cape Town.
  2. Professional Registration: The lead Environmental Engineer must hold a valid registration with the Engineering Council of South Africa (ECSA) and be a Professional Engineer (PrEng) or Professional Technologist (PrTech) in the field of Environmental Engineering. Proof of registration shall be submitted prior to commencement of work.
  3. Delivery Schedule: All deliverables shall be submitted in accordance with the project timeline agreed upon in the Statement of Work. The Environmental Engineer shall provide interim progress reports every two (2) weeks to the designated project officer at the Cape Town Metropolitan Environmental Authority.
  4. Payment Schedule: Payment shall be made in three (3) equal instalments: 30% upon commencement, 40% upon submission of the mid-project deliverables, and 30% upon final acceptance of all deliverables. Invoices shall be submitted to the accounts payable department of the issuing entity in South Africa Cape Town.
  5. Intellectual Property: All reports, data, models, and documentation produced under this Purchase Order shall become the property of the Cape Town Metropolitan Environmental Authority upon full payment. The Environmental Engineer retains the right to use anonymised data for academic publication with prior written consent.
  6. Confidentiality: The Environmental Engineer shall treat all information received in the course of this engagement as strictly confidential. No data pertaining to the South Africa Cape Town environmental baseline shall be disclosed to third parties without written authorisation.
  7. Insurance and Indemnity: The supplier shall maintain professional indemnity insurance of no less than R5,000,000 and public liability insurance of no less than R2,000,000 for the duration of this Purchase Order. Certificates of insurance shall be provided upon request.
  8. Termination: Either party may terminate this Purchase Order with thirty (30) days written notice. In the event of termination, the Environmental Engineer shall be compensated for all work completed and documented up to the date of termination.
  9. Dispute Resolution: Any dispute arising from this Purchase Order shall first be referred to mediation in Cape Town, South Africa. Should mediation fail, the matter shall be referred to the High Court of South Africa, Western Cape Division, Cape Town.
  10. Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the Republic of South Africa.

This Purchase Order is issued in accordance with the Municipal Finance Management Act 56 of 2003 and the Cape Town City Council procurement policy. The undersigned authorises the procurement of the Environmental Engineer services as described herein.
