- This Purchase Order constitutes a binding agreement between Atlantic Coast Productions (Pty) Ltd and the named Film Director for the provision of creative direction services in connection with a feature film production based in Cape Town, South Africa.
- The Film Director shall commence duties on 1 July 2025 and shall complete all deliverables no later than 31 July 2025, unless otherwise agreed in writing by both parties.
- All services shall be performed in Cape Town, South Africa, or at such other locations within the Western Cape Province as may be required for the production schedule. The Film Director is responsible for obtaining any necessary permits from the City of Cape Town for filming in public spaces.
- Payment shall be made within thirty (30) calendar days of receipt of a valid tax invoice from the Film Director. Payment shall be made via electronic funds transfer (EFT) to the bank account specified on the invoice. The currency of this Purchase Order is the South African Rand (ZAR).
- The Film Director warrants that all creative work delivered under this Purchase Order shall be original, free from intellectual property infringement, and shall not violate any applicable South African legislation, including the Copyright Act 98 of 1978 and the Film and Video Production Industry Act 77 of 2017.
- The Film Director shall comply with all health and safety regulations as prescribed by the Occupational Health and Safety Act 85 of 1993 (South Africa) during all on-set activities in Cape Town.
- Either party may terminate this Purchase Order with fourteen (14) days' written notice. In the event of termination, the Film Director shall be compensated for all services rendered up to the date of termination at the rates specified herein.
- This Purchase Order shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising herefrom shall be subject to the exclusive jurisdiction of the High Court of South Africa, Western Cape Division, Cape Town.
- The Film Director shall maintain professional indemnity insurance with a minimum cover of R 5,000,000.00 for the duration of the engagement in South Africa Cape Town.
- All personal data processed in connection with this Purchase Order shall be handled in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA) of South Africa.
