1. Purpose and Scope of This Purchase OrderThis Purchase Order is issued by the Beijing Municipal Fire and Rescue Bureau to procure a comprehensive set of Firefighter protective equipment, operational gear, and specialized rescue tools for deployment across multiple fire stations in China Beijing. The procurement is conducted in accordance with the Government Procurement Law of the People's Republic of China and the national standards GB 27900-2011 (Protective Clothing for Firefighters) and GB 8108-2005 (Protective Helmets for Firefighters). All items specified in this Purchase Order shall be delivered to the designated Firefighter training and equipment warehouses located in the following districts of China Beijing: Chaoyang District (Primary Depot), Haidian District (Secondary Depot), and Tongzhou District (Suburban Reserve). The supplier shall ensure that delivery is completed no later than August 15, 2025. Each shipment must be accompanied by a Certificate of Conformity, a Material Safety Data Sheet (MSDS) where applicable, and a detailed packing list. The supplier is responsible for all transportation, insurance, and unloading costs within the administrative boundaries of China Beijing. Upon delivery, a joint inspection team comprising representatives from the Beijing Municipal Fire and Rescue Bureau and the supplier shall verify the quantity, condition, and compliance of all Firefighter equipment against the specifications stated in this Purchase Order. Any non-conforming items must be replaced within fourteen (14) calendar days at the supplier's sole expense.
4. Payment TermsPayment for this Purchase Order shall be made via bank transfer to the supplier's designated account in accordance with the following schedule: (a) 30% advance payment (CNY 1,332,744.60) within ten (10) business days of mutual signature of this Purchase Order; (b) 50% progress payment (CNY 2,221,241.00) upon successful delivery and joint inspection of all Firefighter equipment at the China Beijing depots; (c) 20% final payment (CNY 888,496.40) within thirty (30) days after the completion of a 90-day performance and durability warranty period. All payments shall be denominated in Chinese Yuan (CNY) and processed through the China Merchants Bank, Beijing Branch. Late payments shall incur a penalty of 0.05% per calendar day, in compliance with the Civil Code of the People's Republic of China.
5. Warranty and After-Sales ServiceThe supplier warrants that all Firefighter equipment delivered under this Purchase Order shall be free from defects in material and workmanship for a minimum period of twenty-four (24) months from the date of acceptance. During the warranty period, the supplier shall provide free repair or replacement of any defective Firefighter gear, SCBA components, or electronic devices. The supplier shall maintain a dedicated after-sales service center in China Beijing with a response time of no more than 48 hours for any warranty claim. Annual calibration and certification services for SCBA units and thermal imaging cameras shall be included for the first three years at no additional cost.
6. Compliance and Regulatory RequirementsImportant Notice: All Firefighter equipment procured under this Purchase Order must bear the China Compulsory Certification (CCC) mark where applicable and must comply with the latest editions of the National Fire Protection Engineering Code (GB 50016) and the Fire Protection Law of the People's Republic of China. The supplier shall provide all necessary documentation to the Beijing Municipal Fire and Rescue Bureau prior to delivery to facilitate regulatory inspection and registration. Failure to comply with any of the above standards shall constitute grounds for immediate rejection of the shipment and termination of this Purchase Order without liability to the Bureau.
7. General Terms and ConditionsThis Purchase Order constitutes the entire agreement between the parties with respect to the procurement of Firefighter equipment for use in China Beijing. Any amendments or modifications to this Purchase Order must be made in writing and signed by authorized representatives of both parties. In the event of any dispute arising from this Purchase Order, the parties shall first attempt to resolve the matter through amicable negotiation. Should negotiation fail, the dispute shall be submitted to the Beijing Arbitration Commission for arbitration in accordance with its then-current rules. The governing law for this Purchase Order shall be the laws of the People's Republic of China. This Purchase Order is executed in two (2) original copies, one for each party, both of which shall carry equal legal validity.
