1. SCOPE OF PURCHASE ORDERThis Purchase Order is issued by the Mumbai Fire Service, a department under the Brihanmumbai Municipal Corporation (BMC), for the procurement of comprehensive Firefighter personal protective equipment (PPE), structural firefighting tools, and emergency response gear. The supplier shall deliver all Firefighter equipment listed in this Purchase Order to the designated Mumbai Fire Service warehouses located at BKC, Bandra Kurla Complex, and the Andheri East Fire Training Academy within India Mumbai. Delivery shall be completed in three (3) phased consignments over a period of sixty (60) calendar days from the date of this Purchase Order. The first consignment (Items 1–5) shall be delivered within 30 days, the second consignment (Items 6–8) within 45 days, and the third consignment (Items 9–10) within 60 days. All goods shall be transported via insured freight within the Mumbai metropolitan region. The supplier bears all risk of loss or damage until the Firefighter equipment is physically received and signed for by the authorized Mumbai Fire Service receiving officer at the India Mumbai delivery address. Delivery shall be made between 09:00 and 16:00 IST, Monday through Saturday, excluding public holidays as declared by the Government of Maharashtra.
4. PAYMENT TERMS4.1 Payment shall be made in Indian Rupees (INR) via RTGS/NEFT transfer to the supplier's designated bank account in Mumbai, India, within thirty (30) days of receipt of a valid tax invoice and the signed Goods Received Note (GRN) for each consignment.
4.2 A retention of ten percent (10%) of the total Purchase Order value shall be withheld until the completion of a ninety (90) day performance warranty period, during which any defective Firefighter equipment shall be replaced or repaired at the supplier's sole cost.
4.3 The supplier shall issue a GST invoice at the applicable rate of eighteen percent (18%) as per the Central Goods and Services Tax Act, 2017, with the correct GSTIN of the Mumbai Fire Service, Brihanmumbai Municipal Corporation.
4.4 Late payment beyond the stipulated period shall attract interest at the rate of 12% per annum, calculated on a daily basis, in accordance with the Micro, Small and Medium Enterprises Development (MSMED) Act, 2006, if the supplier qualifies as an MSME registered in India Mumbai.
5. QUALITY ASSURANCE & COMPLIANCEEvery unit of Firefighter equipment supplied under this Purchase Order must carry a valid Certificate of Conformity issued by a BIS-accredited laboratory in India. The supplier shall provide test reports for thermal resistance, flame spread, chemical resistance, and mechanical strength for each product category. The Mumbai Fire Service reserves the right to conduct random sampling and independent laboratory testing at any recognized NABL-accredited facility in India Mumbai. Any batch found non-compliant shall be rejected in its entirety, and the supplier shall replace the rejected items within fourteen (14) calendar days at no additional cost. The supplier warrants that all Firefighter gear is new, unused, and free from manufacturing defects for a minimum period of two (2) years from the date of delivery.
6. GENERAL TERMS & CONDITIONS6.1 This Purchase Order is governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra, India.
6.2 The supplier shall maintain adequate insurance coverage for all goods in transit within India Mumbai and shall provide proof of insurance upon request.
6.3 The supplier shall comply with all applicable labor laws, environmental regulations, and safety standards of the Government of India and the Government of Maharashtra in the manufacture and supply of Firefighter equipment.
6.4 The Mumbai Fire Service may, at its discretion, modify the quantities specified in this Purchase Order by up to ten percent (10%) without issuing a revised Purchase Order, provided the unit prices remain unchanged.
6.5 Force majeure events, including but not limited to natural disasters affecting the India Mumbai region, shall be addressed through mutual written agreement between the parties.
NOTE: This Purchase Order is issued in accordance with the Brihanmumbai Municipal Corporation Procurement Policy, 2024, and the Government of India's Public Procurement Rules. All Firefighter equipment procured under this order is intended for the exclusive use of Mumbai Fire Service personnel and shall not be resold, transferred, or repurposed without prior written authorization from the Commissioner, Mumbai Fire Service, India Mumbai.For and on behalf of the Buyer:
