This Purchase Order is issued by Munich Advanced Diagnostics GmbH to SciStaff Professional Services AG for the provision of a qualified Laboratory Technician to perform diagnostic, analytical, and quality-control laboratory functions at the buyer's facility located in Germany Munich. The Laboratory Technician shall be responsible for the following duties and responsibilities throughout the contracted period:

  • Preparation, handling, and analysis of biological, chemical, and clinical specimens in accordance with ISO 15189 and German laboratory accreditation standards (DAkkS).
  • Operation, calibration, and routine maintenance of laboratory instrumentation including spectrophotometers, centrifuges, PCR machines, and automated analyzers situated at the Germany Munich facility.
  • Documentation of all experimental procedures, test results, and quality assurance records in compliance with the German Medicines Act (Arzneimittelgesetz) and applicable Bavarian state regulations.
  • Collaboration with senior laboratory scientists and medical directors to ensure accurate and timely delivery of diagnostic reports to referring physicians in the Munich metropolitan area.
  • Adherence to all occupational health and safety protocols as mandated by the German Occupational Safety and Health Act (Arbeitsschutzgesetz) and the Chemicals Act (Chemikaliengesetz).
  • Management of laboratory inventory, including reagents, consumables, and reference materials, ensuring proper storage conditions and timely procurement of supplies.
  • Participation in internal and external quality assessment programs required for the accreditation of the laboratory in Germany Munich.

Payment Terms: Net 30 days from date of invoice. Invoices shall be submitted monthly by the 5th business day. Payment shall be made via SEPA bank transfer to the account designated by SciStaff Professional Services AG. Late payments shall incur interest at the statutory rate under German commercial law (BGB § 288).

The Laboratory Technician assigned under this Purchase Order must meet the following minimum qualifications, as verified by the Service Provider prior to commencement of duties in Germany Munich:

  • Completed vocational training as a Medical Laboratory Assistant (Medizinischer Laboratoriumsassistent) or equivalent qualification recognized under German professional standards.
  • Minimum of three (3) years of practical experience in clinical or research laboratory settings.
  • Working proficiency in German (B2 level minimum) and English (B1 level minimum) for documentation and international collaboration.
  • Valid professional registration and compliance with the German Professional Qualifications Act (Berufsausbildungsgesetz).
  • Current first-aid certification and familiarity with emergency response procedures in a laboratory environment.
  1. This Purchase Order constitutes a binding agreement between the parties upon signature by both authorized representatives. All terms herein shall be governed by and interpreted in accordance with the laws of the Federal Republic of Germany, with specific reference to the commercial regulations applicable in the state of Bavaria, Germany Munich.
  2. The Service Provider warrants that the Laboratory Technician shall perform all duties with the degree of skill, care, and diligence expected of a qualified professional in the German laboratory sector. Any breach of professional standards shall entitle the Purchasing Entity to immediate termination of this Purchase Order without penalty.
  3. The Service Provider shall maintain full liability insurance, professional indemnity insurance, and statutory social security contributions for the Laboratory Technician in accordance with German labor law (SGB IV, SGB V, SGB VII).
  4. Confidentiality: The Laboratory Technician shall be bound by a non-disclosure agreement covering all patient data, proprietary research, and trade secrets encountered during the performance of duties at the Germany Munich facility, in compliance with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).
  5. Termination: Either party may terminate this Purchase Order with a written notice period of thirty (30) calendar days. In cases of material breach, termination may be effected immediately upon written notice.
  6. Dispute Resolution: Any disputes arising from this Purchase Order shall be resolved through mediation in Munich, Germany. Should mediation fail, the competent courts of Munich, Germany shall have exclusive jurisdiction.
  7. Force Majeure: Neither party shall be liable for delays or failures in performance resulting from events beyond reasonable control, including but not limited to natural disasters, pandemics, or government-mandated closures affecting laboratory operations in Germany Munich.
