- This Purchase Order is issued by Harbour City Development Group Pty Ltd and is binding upon acceptance by Mason Building Materials & Supplies (Australia) Pty Ltd. All goods and services referenced herein are to be supplied in accordance with the specifications detailed in this document and the associated project documentation for the Australia Sydney development site.
- Mason shall ensure that all materials supplied comply with the relevant Australian Standards (AS/NZS) applicable to structural, fire, and environmental performance in the Australia Sydney metropolitan region. Certificates of Conformity and test reports must accompany each delivery.
- Delivery of all line items shall be completed no later than 28 June 2025 to the designated delivery address in Pyrmont, Australia Sydney. Mason is responsible for all transport, insurance, and risk of loss until goods are received and signed for by the site supervisor.
- Payment shall be made within thirty (30) calendar days of receipt of a valid tax invoice from Mason. Payment will be processed via electronic funds transfer (EFT) to the bank account nominated by Mason on the invoice. All amounts are quoted in Australian Dollars (AUD) and are inclusive of applicable Goods and Services Tax (GST) at the current rate of 10%.
- Mason warrants that all goods supplied are new, of merchantable quality, and fit for the purpose described in this Purchase Order. A minimum twelve (12) month warranty applies to all structural and building materials from the date of installation.
- In the event of non-conforming goods, Mason shall, at its own cost, replace or repair the affected items within five (5) business days of written notice from the purchaser. Failure to rectify within this period entitles the purchaser to seek alternative supply and recover all associated costs from Mason.
- This Purchase Order is governed by the laws of the State of New South Wales, Australia. Any disputes arising from this Purchase Order shall be subject to the exclusive jurisdiction of the courts of Australia Sydney.
- Mason shall maintain adequate public liability insurance (minimum AUD $20,000,000) and workers' compensation coverage throughout the duration of this Purchase Order and the warranty period. Certificates of insurance must be provided upon request.
- All intellectual property, specifications, and project documentation provided to Mason in connection with this Purchase Order remain the sole property of Harbour City Development Group Pty Ltd and shall not be disclosed to third parties without prior written consent.
- Any variations to this Purchase Order must be agreed in writing by both parties prior to execution. Verbal instructions do not constitute a valid variation to the scope, pricing, or delivery schedule outlined herein.
This Purchase Order is authorised for issue by the undersigned on behalf of Harbour City Development Group Pty Ltd. Acceptance by Mason Building Materials & Supplies (Australia) Pty Ltd shall constitute full agreement to all terms, conditions, specifications, and delivery requirements set forth in this document for the Australia Sydney project.
