3. Scope & Specifications for Mason WorkThis Purchase Order is issued by Sharma Construction & Infrastructure Pvt. Ltd. to engage the services of a qualified Mason and his crew for the execution of all masonry, brickwork, plastering, and screeding activities at the residential housing project located in Sector 18, Rohini, New Delhi, India. The Mason shall be responsible for the complete execution of brick masonry in accordance with the approved architectural and structural drawings, IS 1921 (Code of Practice for Masonry Construction), and all applicable building by-laws of the Delhi Development Authority (DDA). The Mason shall ensure that all brickwork is laid in proper courses with uniform mortar joints, that all walls are plumb and true, and that all plastering achieves the specified thickness and finish. The Mason shall provide all necessary hand tools, scaffolding, and safety equipment for his crew. All materials specified in Line Item 10 shall be procured by the Mason and delivered to the site in New Delhi within the agreed timelines. The Mason shall maintain a minimum crew of twelve (12) skilled masons and four (4) helpers throughout the project duration.
4. Terms & Conditions- Delivery & Commencement: The Mason shall mobilize his crew and commence work at the project site in New Delhi, India, no later than 25 June 2025. The total project duration for all masonry work shall not exceed six (6) calendar months from the date of commencement.
- Quality Standards: All Mason work shall conform to IS 1921, IS 2720, and the specifications outlined in the project drawings. Any work found to be substandard during site inspection by the Project Engineer shall be rectified by the Mason at his own cost within 48 hours of notification.
- Payment Schedule: Payment shall be made in monthly progress installments based on certified work completed. The first installment of 15% shall be due upon successful mobilization. Subsequent monthly payments of 80% of the certified value shall be made within 30 days of invoice submission. The remaining 20% shall be retained as a retention sum and released upon final handover and defect-free completion.
- Defect Liability Period: The Mason shall be liable for any defects in masonry, plastering, or screed work for a period of twelve (12) months from the date of final acceptance. During this period, the Mason shall rectify all reported defects at no additional cost to the purchaser.
- Insurance & Liability: The Mason shall maintain comprehensive workmen's compensation insurance and third-party liability insurance for all his personnel working at the New Delhi site. The Mason shall be solely responsible for any injury, accident, or damage caused by his crew or equipment.
- Compliance with Local Regulations: The Mason shall comply with all applicable labour laws of India, including the Building and Other Construction Workers Act, 1996, and all municipal regulations of the New Delhi Municipal Council (NDMC). All workers shall be provided with proper safety gear, including helmets, gloves, and safety shoes.
- Termination: Either party may terminate this Purchase Order with a written notice of thirty (30) days. In the event of termination by the purchaser due to the Mason's failure to meet quality or schedule requirements, the Mason shall be entitled to payment only for work satisfactorily completed up to the date of termination.
- Dispute Resolution: Any dispute arising out of or in connection with this Purchase Order shall be resolved by arbitration in New Delhi, India, in accordance with the Arbitration and Conciliation Act, 1996. The language of arbitration shall be English.
- Force Majeure: Neither party shall be liable for delays caused by natural disasters, government orders, or events beyond reasonable control. In such cases, the affected party shall notify the other within 72 hours, and the project timeline shall be extended accordingly.
- Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of India. The courts of New Delhi, India, shall have exclusive jurisdiction over any matters arising hereunder.
