This Purchase Order is issued by Golden Pagoda Construction Co., Ltd. to Thura Aung Mason & Brickwork Services for the provision of professional Mason services, masonry materials, and related construction labour for the residential and commercial building project located in Myanmar Yangon. The Mason contractor shall be responsible for all bricklaying, blockwork, plastering, tile setting, and structural masonry activities as detailed in the line items below. - Delivery & Commencement: The Mason contractor shall mobilise all personnel, tools, and materials to the Myanmar Yangon project site no later than 21 June 2025. Physical work shall commence within three (3) working days of mobilisation.
- Completion Deadline: All masonry works described in this Purchase Order must be substantially completed by 30 November 2025. Any delay beyond this date, not caused by force majeure, shall incur a penalty of 0.5% of the total Purchase Order value per calendar day of delay, capped at 10%.
- Quality Standards: All Mason workmanship must meet the specifications outlined in the Myanmar Building Code (2019 revision) and the Myanmar Yangon City Development Committee guidelines. The site engineer of Golden Pagoda Construction Co., Ltd. reserves the right to reject any masonry work that does not conform to the approved drawings and tolerances.
- Payment Terms: Payment shall be made in four (4) progress instalments: 25% upon commencement and material delivery to the Myanmar Yangon site; 30% upon completion of all structural brickwork and blockwork; 30% upon completion of plastering and tile setting; and 15% upon final inspection, snag list clearance, and handover. All payments shall be made via bank transfer to the account specified by the Mason contractor within fourteen (14) days of invoice approval.
- Warranty: The Mason contractor provides a twelve (12) month defect liability period from the date of final acceptance. Any cracks, delamination, or structural masonry defects arising within this period shall be rectified at the sole cost of the Mason contractor.
- Health, Safety & Compliance: The Mason contractor shall ensure that all workers on the Myanmar Yangon site comply with Myanmar labour laws, wear appropriate personal protective equipment (PPE), and adhere to the site safety plan. The contractor shall carry valid workers' compensation insurance for all Mason crew members.
- Subcontracting: The Mason contractor shall not subcontract any portion of the masonry work without prior written consent from the Purchaser. Any approved subcontractor shall be bound by the same terms as this Purchase Order.
- Dispute Resolution: Any dispute arising from this Purchase Order shall first be resolved through good-faith negotiation. If unresolved within thirty (30) days, the matter shall be referred to arbitration under the rules of the Myanmar Arbitration Centre in Myanmar Yangon. The language of arbitration shall be English.
- Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the Republic of the Union of Myanmar.
- Validity: This Purchase Order is valid for acceptance within seven (7) calendar days from the date of issue. Failure to accept within this period shall render this Purchase Order null and void.
