This Purchase Order is issued by Kathmandu Infrastructure Development Pvt. Ltd. (hereinafter referred to as the "Buyer") to Shree Himalayan Mason & Construction Services (hereinafter referred to as the "Vendor") for the procurement of qualified Mason labor, masonry materials, and associated construction services required for the construction of a 12-storey residential tower located in the Baneshwor district of Nepal Kathmandu. This Purchase Order governs all terms, conditions, deliverables, and payment obligations related to the engagement of Mason professionals and the supply of masonry-related goods for the duration of the project.

All Mason labor and materials specified in this Purchase Order shall be delivered to the project site at Baneshwor, Nepal Kathmandu, no later than 21 June 2025. The Vendor shall ensure that a minimum of 24 skilled Masons and 16 helpers are present on-site by the commencement date. Materials including bricks, cement, mortar, and reinforcement shall be staged at the Nepal Kathmandu project warehouse in phases aligned with the construction schedule. The Vendor is responsible for all transportation, loading, and unloading within the Kathmandu Valley. Delivery windows shall be between 07:00 and 17:00 Nepal Standard Time, Monday through Saturday, in compliance with local municipal regulations in Nepal Kathmandu.
All Mason work shall conform to the Nepal National Building Code (NBC) 2015 and the specifications outlined in the project drawings approved by the Department of Urban Development and Building Construction (DUDBC), Kathmandu. Bricks shall meet IS 1077 standards. Cement shall be certified by the Nepal Bureau of Standards and Specification (NBSS). The Vendor shall provide material test certificates for every batch of bricks, cement, and reinforcement delivered to the Nepal Kathmandu site. A site engineer appointed by the Buyer shall inspect Mason work at each stage, and any non-conforming work shall be rectified at the Vendor's cost within 48 hours.
Payment against this Purchase Order shall be made in the following schedule: (a) 25% advance payment upon signing of the Purchase Order and submission of a bank guarantee from a commercial bank operating in Nepal Kathmandu; (b) 50% progress payment upon completion of masonry work up to the 6th floor, subject to inspection and approval; (c) 20% upon completion of all masonry work and waterproofing; (d) 5% retention released 90 days after final handover. All payments shall be made via bank transfer to the Vendor's account in Nepalese Rupees (NPR) within 30 days of receipt of a valid tax invoice. The Vendor shall issue a VAT-compliant invoice registered with the Inland Revenue Department, Nepal Kathmandu.
(a) This Purchase Order is governed by the laws of the Kingdom of Nepal, and any disputes shall be resolved through arbitration in Kathmandu in accordance with the Arbitration Act, 1999. (b) The Vendor shall maintain comprehensive workmen's compensation insurance and third-party liability insurance covering all Masons and helpers engaged under this Purchase Order. (c) The Vendor shall comply with all labor laws of Nepal, including the Labor and Employment Act, 2074, and shall not engage any Mason below the age of 18. (d) The Buyer reserves the right to withhold payment for any defective Mason work or non-delivery of materials. (e) Force majeure events, including monsoon-related delays common in Nepal Kathmandu, shall extend the delivery timeline by a mutually agreed number of days. (f) The Vendor shall not subcontract any Mason labor without prior written consent from the Buyer.
This Purchase Order becomes effective upon signature by both parties. The Vendor acknowledges receipt of this Purchase Order and confirms acceptance of all terms, quantities, and pricing as stated herein. Any amendments to this Purchase Order must be made in writing and signed by authorized representatives of both parties.
