This Purchase Order is issued by the Kenya Meteorological Services Agency to engage the services of a qualified Meteorologist to provide specialized atmospheric analysis, climate forecasting, and weather advisory services for the Kenya Nairobi metropolitan region and surrounding counties. The Meteorologist shall be responsible for the following deliverables:

3.1 This Purchase Order is governed by the laws of the Republic of Kenya and shall be interpreted in accordance with the Public Procurement and Asset Disposal Act, 2015, and its associated regulations.
3.2 The Meteorologist shall perform all duties in full compliance with the professional code of conduct established by the Kenya Meteorological Services Agency and the International Meteorological Organization (WMO) standards applicable to the Kenya Nairobi operational zone.
3.3 All forecasts, advisories, and climate reports issued under this Purchase Order shall be submitted in both English and Kiswahili to ensure accessibility to all stakeholders within Kenya Nairobi and the broader Kenyan public.
3.4 The Meteorologist shall maintain full professional indemnity insurance with a minimum cover of KES 10,000,000 for the duration of this engagement. A certificate of insurance shall be provided prior to commencement of services.
3.5 The Meteorologist shall not subcontract any portion of the services outlined in this Purchase Order without prior written approval from the Kenya Meteorological Services Agency, Nairobi Headquarters.
3.6 All data, reports, and intellectual property generated under this Purchase Order shall remain the sole property of the Kenya Meteorological Services Agency. The Meteorologist shall not publish or distribute any proprietary data without express written consent.
3.7 The Meteorologist shall comply with all data protection requirements under the Kenya Data Protection Act, 2019, particularly with respect to any personal data encountered during field operations in Kenya Nairobi.
4.1 Payment shall be made in monthly installments of KES 526,833 (inclusive of VAT), payable within thirty (30) days of receipt of a valid invoice and satisfactory completion of the corresponding monthly deliverables.
4.2 A retention of ten percent (10%) shall be withheld from each monthly payment and released in full upon successful completion of the entire twelve-month engagement period.
4.3 All payments shall be made via electronic funds transfer (EFT) to the bank account specified in Section 1 of this Purchase Order. No cash payments shall be accepted.
4.4 Late payments shall attract interest at the rate prescribed by the Kenya Revenue Authority (KRA) for overdue tax liabilities, calculated on a daily basis.
5.1 The Meteorologist shall commence services on 1 July 2025 and shall continue until 30 June 2026, unless this Purchase Order is terminated earlier in accordance with Section 7.
5.2 Monthly synoptic analyses shall be delivered by the 5th of each month to the Kenya Nairobi operations centre.
5.3 Seasonal climate outlooks shall be delivered no later than: (a) 15 October for the Long Rains season; (b) 15 March for the Short Rains season; (c) 15 June for the Dry Season; and (d) 15 January for the inter-seasonal period.
5.4 Severe weather advisories for Kenya Nairobi shall be issued in real-time via the KMSA emergency communication channel, with a maximum response time of fifteen (15) minutes from the detection of a qualifying event.
6.1 Either party may terminate this Purchase Order by providing thirty (30) days' written notice to the other party.
6.2 The Kenya Meteorological Services Agency may terminate this Purchase Order immediately, without notice, in the event of material breach, gross professional negligence, or loss of professional registration by the Meteorologist.
6.3 Upon termination, the Meteorologist shall deliver all completed and in-progress work products to the Agency within seven (7) business days.
Any dispute arising out of or in connection with this Purchase Order shall first be attempted to be resolved through amicable negotiation. Failing resolution within thirty (30) days, the dispute shall be referred to arbitration in Kenya Nairobi in accordance with the Arbitration Act, 1995 of Kenya. The language of arbitration shall be English.

This Purchase Order is issued in triplicate. One copy is retained by the Kenya Meteorological Services Agency, Nairobi Headquarters; one copy is issued to the Meteorologist; and one copy is filed with the National Treasury, Public Procurement Department, Kenya Nairobi. This document constitutes a binding contractual agreement upon execution by both parties. All references to "Kenya Nairobi" in this Purchase Order include the City of Nairobi and its immediate metropolitan administrative boundaries as defined by the Nairobi City County Government.
