This Purchase Order is issued by Harbourview Medical Centre Pty Ltd to procure the services of qualified Nurse professionals through Pacific Coast Nursing Solutions Ltd for deployment across multiple clinical departments within the Australia Sydney metropolitan region. All Nurse personnel engaged under this Purchase Order must satisfy the following mandatory requirements:
- Hold a current, unencumbered registration with the Australian Health Practitioner Regulation Agency (AHPRA) as either a Registered Nurse or Enrolled Nurse, as applicable to the specific role.
- Provide a valid National Police Check (NSW) and Working With Children Check (where applicable) prior to commencing duties in Australia Sydney.
- Complete all mandatory induction training, including infection control, manual handling, emergency response, and cultural safety protocols specific to the Australia Sydney healthcare environment.
- Maintain current CPR and First Aid certification in accordance with Resuscitation Council (Australia) guidelines throughout the engagement period.
- Adhere to the Nursing and Midwifery Board of Australia (NMBA) Code of Conduct and all applicable NSW Health regulations.
- Comply with all workplace health and safety obligations under the Work Health and Safety Act 2011 (NSW) and the specific policies of Harbourview Medical Centre, Sydney.
- Contract Duration: This Purchase Order covers a 12-month engagement period commencing 1 July 2025 and concluding 30 June 2026, unless terminated earlier in accordance with Clause 7. All Nurse services must be delivered within the Australia Sydney metropolitan area as specified in the line items above.
- Payment Schedule: Invoices for Nurse services rendered shall be submitted monthly by the 5th business day of the following month. Payment shall be made within 30 days of receipt of a valid tax invoice in accordance with the Australian Taxation Office requirements. All amounts are denominated in Australian Dollars (AUD).
- Performance Standards: Pacific Coast Nursing Solutions Ltd shall ensure that all Nurse personnel meet or exceed the clinical performance benchmarks established by Harbourview Medical Centre. Quarterly performance reviews of each Nurse will be conducted by the Supervisory Nurse Manager (Item 06) and reported to the Chief Nursing Officer.
- Substitution of Nurse Personnel: The Supplier may substitute a Nurse for a specific position only with prior written approval from the Buyer. Any replacement Nurse must meet or exceed the qualifications, experience, and registration requirements specified in this Purchase Order for the Australia Sydney deployment.
- Confidentiality: All Nurse personnel engaged under this Purchase Order shall be bound by strict confidentiality obligations regarding patient information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Breach of patient confidentiality in the Australia Sydney healthcare context shall constitute immediate grounds for termination.
- Insurance and Indemnity: The Supplier shall maintain, at its own cost, professional indemnity insurance of no less than $20,000,000 per claim and public liability insurance of no less than $20,000,000 for the duration of this Purchase Order. The Supplier shall indemnify the Buyer against all claims arising from the negligent acts or omissions of any Nurse deployed under this agreement.
- Termination: Either party may terminate this Purchase Order with 60 days' written notice. The Buyer may terminate immediately for material breach, including but not limited to a Nurse's loss of AHPRA registration, serious misconduct, or failure to meet clinical safety standards in the Australia Sydney operating environment.
- Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia. Any disputes shall be resolved through the courts of Australia Sydney or by arbitration in accordance with the Arbitration Act 2010 (NSW).
- Compliance with Australian Healthcare Regulations: All Nurse services procured under this Purchase Order must comply with the Health Services Act 1987 (NSW), the Health Records and Information Privacy Act 2002 (NSW), and all relevant Australian Government and NSW Health directives applicable to the provision of nursing services in Australia Sydney.
All Nurse personnel shall report to Harbourview Medical Centre, 42 George Street, Sydney NSW 2000, Australia, for induction and orientation no later than 48 hours prior to their respective start dates as outlined in Section 3. The Supplier is responsible for arranging all travel, accommodation (where applicable for Nurse staff relocating to Australia Sydney), and onboarding logistics.
