- This Purchase Order is issued in accordance with the Public Procurement and Asset Disposal Act (No. 33 of 2015) of Kenya and all applicable regulations governing the procurement of professional nursing services in Kenya Nairobi.
- The Service Provider shall ensure that every Nurse deployed under this Purchase Order holds a valid and current licence issued by the Kenya Nursing and Midwifery Council (KNMC) and is registered with the Nursing and Midwifery Board of Kenya (KNNB). Copies of all licences shall be submitted prior to commencement.
- All Nurse personnel shall be subject to a comprehensive background check, including police clearance from the Kenya National Police Service, medical fitness certification from a government-approved facility in Kenya Nairobi, and verification of academic credentials from the relevant nursing institutions.
- The Service Provider shall bear full responsibility for the employment, remuneration, statutory deductions (NSSF, NHIF/SHIF, PAYE), and any labour disputes pertaining to the Nurse staff assigned under this Purchase Order.
- Shift rosters for all Nurse positions shall be submitted to the Nairobi County Health Services Board no later than the 25th of each preceding month. Any changes to the roster must be communicated in writing at least 72 hours in advance.
- The Service Provider shall maintain a minimum 95% Nurse attendance rate. Failure to meet this threshold for two consecutive months shall constitute a material breach of this Purchase Order and may result in termination with 30 days' written notice.
- Payment shall be processed within 30 calendar days of receipt of a valid invoice and the monthly Nurse attendance and performance report. Invoices must be submitted to the Procurement Department, Nairobi County Health Services Board, Kenya Nairobi, by the 5th of the following month.
- All Nurse personnel shall comply with the code of conduct, patient confidentiality policies (in line with the Data Protection Act, 2019 of Kenya), and clinical protocols established by the Nairobi County Health Services Board.
- The Service Provider shall provide continuous professional development (CPD) training for all Nurse staff at a minimum of 40 hours per annum, with costs borne by the Service Provider as part of this Purchase Order.
- This Purchase Order shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from this Purchase Order shall be resolved through arbitration in Kenya Nairobi in accordance with the Arbitration Act, 1995.
- Force majeure events, including but not limited to public health emergencies declared by the Government of Kenya, shall suspend obligations under this Purchase Order without penalty to either party.
By signing below, both parties acknowledge and agree to all terms, conditions, and obligations set forth in this Purchase Order for the provision of Nurse services in Kenya Nairobi. This document constitutes a binding agreement effective from the date of the last signature.
