- This Purchase Order is issued by ClearVision Optometry Group Sdn. Bhd. for the procurement of Optometrist professional services and related equipment maintenance in Malaysia Kuala Lumpur. The supplier, Dr. Ahmad Farid bin Hassan, Optometrist, hereby acknowledges and accepts all terms stated herein.
- All Optometrist services shall be rendered in compliance with the Malaysian Medical Council (MMC) guidelines and the regulations set forth by the Ministry of Health Malaysia (MOH). The Optometrist must hold a valid practising certificate issued under the Optometrists Act 2019 (Act 821) of Malaysia.
- Payment shall be made within thirty (30) calendar days from the date of receipt of a valid tax invoice. Payment shall be processed via bank transfer to the supplier's designated account in Malaysia Kuala Lumpur. Late payments shall attract interest at the rate of 5% per annum as stipulated under the Malaysian Contracts Act 1950.
- The supplier guarantees that all Optometrist examinations, consultations, and assessments will be conducted at the designated facility in Malaysia Kuala Lumpur or at the corporate client's premises as mutually agreed in writing. All patient records shall be maintained in accordance with the Personal Data Protection Act 2010 (PDPA) of Malaysia.
- Equipment calibration and maintenance (Item No. 05) shall be performed by the Optometrist or a duly authorised technician. A written calibration certificate shall be provided upon completion of each service visit in Malaysia Kuala Lumpur.
- The CPD Training Workshop (Item No. 06) shall be conducted at the OptiCare Professional Services premises in Bangsar South, Malaysia Kuala Lumpur. The Optometrist shall ensure that the workshop content meets the requirements of the Malaysian Optometrists and Dispensing Opticians Board (MODOB) for continuing education credits.
- Any changes to the scope, quantity, or schedule of this Purchase Order must be made in writing and signed by both parties. No verbal modifications shall be binding.
- In the event of a dispute arising from this Purchase Order, both parties agree to first attempt resolution through mediation in Malaysia Kuala Lumpur. Should mediation fail, the matter shall be referred to arbitration under the Arbitration Act 2005 of Malaysia, with the seat of arbitration in Malaysia Kuala Lumpur.
- This Purchase Order is governed by and shall be construed in accordance with the laws of Malaysia. The jurisdiction of the courts of Malaysia Kuala Lumpur shall apply to any legal proceedings.
- The supplier shall maintain professional indemnity insurance with a minimum coverage of MYR 2,000,000 for all Optometrist services rendered under this Purchase Order. Proof of insurance shall be provided upon request.
By signing below, both parties confirm that this Purchase Order for Optometrist services in Malaysia Kuala Lumpur is executed in good faith and constitutes a binding agreement between the parties.
