Terms and Conditions of this Purchase Order

1. This Purchase Order is issued by the Office of the Politician, Hon. Dña María Élvarez Sánchez, acting in her capacity as Consellera de Transparència within the Generalitat Valenciana, located in Spain Valencia. All transactions are governed by the Ley 9/2017 del Contrato del Sector Público and applicable regulations of the Comunitat Valenciana.
2. The supplier, Iberia Técnica y Servicios, S.L., acknowledges that this Purchase Order constitutes a binding commitment to deliver all goods and services as specified in the line items above. Any deviation from the described specifications must be approved in writing by the Politician's designated procurement officer prior to delivery.
3. Delivery of all items shall be made to the Politician's office at the Edifici de la Generalitat, Plaça de l'Ajuntament, 1, 46002 València, Spain Valencia, between 09:00 and 14:00 hours on the dates indicated. The supplier bears all costs of transportation, insurance, and risk of loss until goods are received and signed for by the Politician's office staff.
4. Payment shall be made by direct bank transfer to the IBAN specified above within thirty (30) calendar days of the Politician's office receiving a valid, itemized invoice that references this Purchase Order number (SV-2025-04782). Late payment shall accrue interest at the rate established by Ley 3/2004 de lucha contra la morosidad en las operaciones comerciales.
5. All equipment and materials procured under this Purchase Order shall comply with current Spanish and European Union safety, environmental, and accessibility standards. The supplier warrants that all goods are new, free from defects, and fit for the intended public-service purpose within the Politician's office in Spain Valencia.
6. The supplier shall maintain full confidentiality regarding the Politician's operational details, security protocols, and any sensitive information encountered during the course of installation or service. A breach of confidentiality shall result in immediate termination of this Purchase Order and potential legal action under Spanish data protection law.
7. Warranty: All hardware items carry a minimum two-year manufacturer's warranty from the date of acceptance. The Politician's office reserves the right to reject any item that does not conform to the specifications stated in this Purchase Order, at the supplier's sole cost for replacement or repair.
8. This Purchase Order may be amended only by mutual written agreement signed by both the Politician's authorized representative and the supplier's legal representative. No verbal modifications shall be binding.
9. Disputes arising from this Purchase Order shall be resolved in the competent courts of València, Spain Valencia, in accordance with Spanish civil and administrative law. The supplier irrevocably submits to the jurisdiction of the Juzgados de Primera Instancia de València.
10. This Purchase Order is valid for acceptance until 30 June 2025. Failure to confirm acceptance by the supplier within this period shall render this document null and void, and the Politician's office shall be free to re-tender the procurement.
