Terms and Conditions – Purchase Order PO-UMD-2025-04871
- This Purchase Order is issued by the Universidad Nacional de Medellín, located in the city of Medellín, Antioquia, Colombia, in accordance with Colombian public procurement regulations (Ley 80 de 1993 and Decreto 1082 de 2015) and the university's internal procurement policy.
- All goods and services listed herein are intended exclusively for the use of Professor Dr. Elena María Restrepo Gutiérrez, Full Professor of the Department of Applied Mathematics, and her directly supervised research group. The Professor shall be the primary recipient and custodian of all delivered items.
- Delivery shall be made to the Universidad Nacional de Medellín, Building 4, Floor 3, Calle 42 No. 42A-00, El Poblado, Medellín, Antioquia, Colombia. The vendor is responsible for all transportation, insurance, and installation within the Medellín metropolitan area.
- Payment shall be processed in Colombian Pesos (COP) via electronic bank transfer (EFT) to the vendor's designated account within thirty (30) calendar days from the date of the valid electronic invoice (factura electrónica) issued in compliance with DIAN regulations (Resolución 000042 de 2023).
- The vendor warrants that all equipment is new, free of defects, and complies with Colombian technical standards (NTC) and safety regulations. A minimum warranty period of twenty-four (24) months applies to all hardware items, with on-site service coverage in Medellín and the surrounding Antioquia department.
- Any modification, cancellation, or change in scope of this Purchase Order must be authorized in writing by the university's Office of Procurement and signed by the Professor's departmental head. Unauthorized changes shall be null and void under Colombian civil law (Código de Comercio, Articles 860–870).
- The vendor shall comply with all applicable labor, environmental, and tax obligations under Colombian law. The vendor's NIT and RUT information must be verified through the DIAN RUT database prior to contract execution.
- Disputes arising from this Purchase Order shall be resolved through the competent courts of the city of Medellín, Antioquia, Colombia, in accordance with Colombian procedural law. The parties agree to attempt mediation before the Centro de Arbitraje y Conciliación de la Cámara de Comercio de Medellín prior to initiating litigation.
- This Purchase Order becomes effective upon signature by both parties and remains valid until full delivery, installation, and acceptance of all line items by the Professor and the university's asset management office.
- All intellectual property related to the software licenses listed in Item 06 shall remain with the respective licensors. The Professor and her research group are granted non-transferable, non-exclusive usage rights limited to academic and research purposes at the Universidad Nacional de Medellín.
