This Purchase Order is issued to formally engage the services of a qualified School Counselor to provide comprehensive student welfare, psychological support, and academic guidance services across the Sydney Metropolitan Public Schools Division. The School Counselor shall operate in accordance with the Australian Education Standards and the New South Wales Department of Education Student Wellbeing Policy (2024 Revision).

The engaged School Counselor shall fulfil the following obligations throughout the contract period in Australia Sydney:
(a) Maintain full professional registration with the Australian Association for Student Counselling and Therapeutic Work (AASCT) and hold a valid Working With Children Check (WWCC) issued by the NSW Office of the Children's Guardian.
(b) Deliver all counselling services in compliance with the Privacy Act 1988 (Cth), the NSW Information Privacy and Protection Act 1998, and the Australian Privacy Principles (APPs).
(c) Operate from the designated Student Wellbeing Centre located at 100 George Street, Australia Sydney, NSW 2000, and be available on-site a minimum of five (5) days per week during the academic term.
(d) Maintain strict confidentiality of all student records, with disclosure only in accordance with legal obligations, mandatory reporting requirements under the Children and Young Persons (Care and Protection) Act 1999 (NSW), or with written parental consent.
(e) Collaborate with school principals, classroom teachers, and the broader Australia Sydney education community to implement evidence-based mental health strategies aligned with the Australian Curriculum: Foundation to Year 12.
(f) Submit monthly activity reports and quarterly outcome summaries to the Director of Student Services, Sydney Metropolitan Public Schools Division.
All payments under this Purchase Order shall be made in Australian Dollars (AUD) via electronic funds transfer (EFT) to the supplier's nominated bank account. Invoices are to be submitted monthly by the 5th business day of the following month. Payment shall be processed within thirty (30) calendar days of receipt of a valid tax invoice. Late payments shall accrue interest at the rate prescribed under the Interest on Late Payments of Government Debts Act 1983 (Cth). The total contract value of AUD 195,300.00 is inclusive of all applicable Goods and Services Tax (GST) at the current rate of 10%.
- This Purchase Order is governed by the laws of the State of New South Wales, Australia, and the Commonwealth of Australia. Any disputes shall be resolved through the NSW Civil and Administrative Tribunal (NCAT) or, where the amount exceeds the jurisdictional limit, the Supreme Court of New South Wales, Australia Sydney.
- The School Counselor shall maintain professional indemnity insurance with a minimum cover of AUD 5,000,000 per claim and public liability insurance of AUD 10,000,000 for the duration of this engagement.
- Either party may terminate this Purchase Order with thirty (30) days' written notice. In the event of termination for convenience, the supplier shall be compensated for services rendered up to the termination date.
- The supplier warrants that all services will be performed with reasonable skill, care, and diligence, in accordance with the professional standards established by AASCT and the Australian Psychological Society (APS) Code of Ethics.
- All intellectual property, including curriculum materials, workshop designs, and assessment tools developed specifically for the Sydney Metropolitan Public Schools Division under this Purchase Order, shall remain the property of the Division upon completion of payment.
- The supplier shall comply with all applicable Australian workplace health and safety legislation, including the Work Health and Safety Act 2011 (NSW), and shall complete all mandatory induction and safety training prior to commencing on-site duties in Australia Sydney.
- This Purchase Order does not create an employment relationship. The School Counselor is engaged as an independent contractor and is responsible for all personal income tax obligations under the Australian Taxation Office (ATO) guidelines.
By signing below, both parties acknowledge and agree to all terms, conditions, and obligations set forth in this Purchase Order for the engagement of a School Counselor within the Australia Sydney education jurisdiction.
