- Scope of Engagement: This Purchase Order authorizes the engagement of Dr. Andrés Felipe Cárdenas Molina as the designated School Counselor for the 2025 academic year at Colegio Distrital San Agustín, located in the city of Colombia Bogotá (Distrito Capital). The School Counselor shall provide comprehensive psychosocial, academic, and vocational guidance services to all enrolled students in accordance with the institutional mission and the regulatory framework established by the Colombian Ministry of National Education.
- Professional Qualifications: The School Counselor must hold a valid professional registration with the Consejo de Psicología de Colombia, a minimum of five (5) years of documented experience in educational counseling within the Bogotá D.C. school system, and demonstrated familiarity with the Ley 115 de 1994 and its implementing decrees. The School Counselor shall maintain all required professional licenses throughout the duration of this Purchase Order.
- Work Schedule and Location: Services shall be rendered on-site at the school premises located at Cra. 15 # 85-42, Zona Rosa, Bogotá D.C., Colombia, Monday through Friday, from 7:30 a.m. to 3:30 p.m., with a one-hour lunch break. The School Counselor shall be available for emergency consultations outside regular hours as needed, in coordination with the school administration.
- Payment Terms: Payment for services rendered under this Purchase Order shall be made via electronic bank transfer (transferencia electrónica) to the account designated by the School Counselor, within thirty (30) calendar days of receipt of a valid invoice (factura electrónica) compliant with the DIAN (Dirección de Impuestos y Aduanas Nacionales) electronic invoicing regulations of Colombia. All payments are denominated in Colombian Pesos (COP).
- Tax Obligations: The School Counselor is responsible for the declaration and payment of all applicable taxes, including but not limited to the Impuesto de Renta, IVA (where applicable), and the ICA (Impuesto al Consumo) levied by the Distrito Capital de Bogotá. The issuing institution shall withhold the applicable statutory retention at source (retención en la fuente) in accordance with Colombian tax law (Estatuto Tributario, Art. 368 et seq.).
- Confidentiality and Data Protection: The School Counselor shall adhere strictly to the Ley 1581 de 2012 (Ley de Protección de Datos Personales) and the General Data Protection regulations of Colombia. All student records, counseling session notes, and psychosocial assessments shall be treated as strictly confidential and shall not be disclosed to any third party without the written consent of the student's legal guardian, except in cases mandated by Colombian law (e.g., Ley 1098 de 2006, Código de Infancia y Adolescencia).
- Termination: Either party may terminate this Purchase Order with a written notice of thirty (30) days. In the event of termination for cause, the School Counselor shall be compensated for all services rendered up to the effective date of termination. The institution reserves the right to terminate immediately in cases of professional misconduct, breach of confidentiality, or failure to meet the performance standards established by the Secretaría de Educación de Bogotá.
- Dispute Resolution: Any dispute arising from this Purchase Order shall be resolved through amicable negotiation. Failing resolution within fifteen (15) days, the matter shall be submitted to the competent labor and administrative courts of Bogotá D.C., Colombia, in accordance with the applicable procedural norms of the Colombian legal system.
- Force Majeure: Neither party shall be liable for failure to perform obligations under this Purchase Order due to events beyond reasonable control, including but not limited to natural disasters, public health emergencies declared by the Ministry of Health and Social Welfare of Colombia, or government-ordered school closures in Bogotá D.C.
- Compliance with Local Regulations: The School Counselor shall comply with all municipal ordinances, district resolutions, and educational policies issued by the Alcaldía Mayor de Bogotá D.C. and the Secretaría de Educación del Distrito Capital. The School Counselor shall participate in mandatory professional development programs organized by the district education authority during the academic year.
By signing below, the parties acknowledge and agree to all terms, conditions, and obligations set forth in this Purchase Order for the engagement of the School Counselor at the specified institution in Colombia Bogotá. This document constitutes a binding procurement instrument under Colombian administrative and civil law.
