This Purchase Order specifically covers the engagement of qualified School Counselor professionals to deliver comprehensive student support services across designated public school campuses in United States New York City. The School Counselor services shall include, but are not limited to: individual and group academic counseling, career guidance and college readiness programming, social-emotional learning interventions, crisis response and mental health referrals, parent and family engagement sessions, and coordination with external community mental health providers operating within the United States New York City area.
All School Counselor personnel engaged under this Purchase Order must hold a valid New York State School Counselor certification (NYSED Certificate 6006 or equivalent), possess a minimum of three (3) years of documented experience in a K-12 educational setting, and maintain current registration with the New York City Department of Education's Office of Student Support Services. The School Counselor must also comply with all confidentiality standards set forth under FERPA (Family Educational Rights and Privacy Act) and New York State Education Law, Section 2-d.

- Governing Jurisdiction: This Purchase Order shall be governed by and construed in accordance with the laws of the State of New York and all applicable regulations within United States New York City. Any disputes arising from this Purchase Order shall be resolved in the courts of New York County, United States New York City.
- Payment Terms: Payment shall be made net thirty (30) days from receipt of an approved invoice. Invoices must reference this Purchase Order number (PO-2025-NYC-SC-04782) and be submitted to the Accounts Payable Division, New York City Department of Education, 100 Church Street, New York, NY 10013.
- Performance Standards: The School Counselor services must meet or exceed the performance benchmarks established by the New York City Department of Education's Office of Student Support Services. Quarterly performance reviews will be conducted, and failure to meet minimum standards for two consecutive quarters may result in termination of this Purchase Order with thirty (30) days written notice.
- Confidentiality: All School Counselor personnel must adhere to strict confidentiality protocols. Student records, counseling notes, and personal information shall be handled in full compliance with FERPA, New York State Education Law, and the New York City Administrative Code. Violation of confidentiality terms constitutes grounds for immediate termination of this Purchase Order.
- Insurance and Liability: The service provider shall maintain professional liability insurance with a minimum coverage of $2,000,000 per occurrence and $5,000,000 aggregate, as well as workers' compensation insurance, for the duration of this Purchase Order. Certificates of insurance must be provided prior to the Effective Date.
- Anti-Discrimination: All School Counselor services delivered under this Purchase Order must be provided in a non-discriminatory manner in compliance with Title VI of the Civil Rights Act, the Americans with Disabilities Act, and New York City Human Rights Law. Services must be accessible to all students regardless of race, ethnicity, gender, sexual orientation, disability, or socioeconomic status within United States New York City.
- Termination: Either party may terminate this Purchase Order with sixty (60) days written notice. The New York City Department of Education reserves the right to terminate this Purchase Order immediately for cause, including but not limited to material breach, fraud, or failure to maintain required School Counselor certifications.
- Compliance with NYC Procurement: This Purchase Order is subject to the New York City Procurement Policy and all applicable rules of the New York City Comptroller. The vendor certifies that it is not debarred or suspended from doing business with the City of New York.
- Amendments: No modification to this Purchase Order shall be valid unless made in writing and signed by authorized representatives of both parties. Any change in scope, pricing, or duration of School Counselor services must be documented in a formal Purchase Order amendment.
