- Scope of Work: The Supplier shall complete all Teacher Secondary recruitment, training, and onboarding activities within the Dhaka Division of Bangladesh as specified in this Purchase Order. All Teacher Secondary candidates must hold a minimum Bachelor's degree in the relevant subject along with a B.Ed. (Bachelor of Education) degree recognized by the University Grants Commission of Bangladesh.
- Delivery Timeline: The Supplier shall submit a detailed implementation plan within 10 working days of this Purchase Order. The first batch of Teacher Secondary personnel shall be deployed to their assigned secondary schools in Dhaka no later than 30 August 2025, in time for the new academic year commencing in September 2025.
- Payment Terms: Payment shall be made in three installments: 30% upon successful completion of the recruitment and verification phase; 40% upon completion of the pre-service Teacher Secondary training program at BTTDI Dhaka; and 30% upon final deployment and confirmation of all Teacher Secondary staff in their respective schools across Bangladesh Dhaka. Payment shall be processed via government bank transfer to the Supplier's designated account.
- Quality Assurance: All Teacher Secondary candidates must pass a written examination, a practical teaching demonstration, and a psychological fitness assessment administered by the Directorate of Secondary and Higher Education, Dhaka. The Supplier is responsible for ensuring that 100% of deployed Teacher Secondary personnel meet the minimum qualification and competency standards set by the Bangladesh Education Board.
- Compliance with Local Law: This Purchase Order is governed by the laws of the People's Republic of Bangladesh. All activities related to Teacher Secondary recruitment and training shall comply with the Bangladesh Labour Act 2006, the National Education Policy 2010, and the Government Procurement Rules 2021. The Supplier must obtain all necessary permits and clearances from the Dhaka City Corporation and relevant local authorities in Bangladesh Dhaka.
- Confidentiality: The Supplier shall maintain strict confidentiality regarding the personal data, examination results, and internal deliberations pertaining to Teacher Secondary candidates. All records shall be stored in accordance with the Digital Security Act 2018 of Bangladesh.
- Penalties and Default: Failure to meet the delivery timeline for Teacher Secondary deployment in Dhaka shall attract a penalty of 0.5% of the total Purchase Order value per day of delay, up to a maximum of 10%. In the event of material breach, the Directorate reserves the right to terminate this Purchase Order with 15 days' written notice.
- Dispute Resolution: Any dispute arising from this Purchase Order shall first be attempted to be resolved through amicable negotiation between the parties. If unresolved within 30 days, the matter shall be referred to the Arbitration Tribunal established under the Bangladesh Arbitration Act 2001, seated in Dhaka, Bangladesh.
- Force Majeure: Neither party shall be liable for delays caused by natural disasters, government-imposed lockdowns, or other events beyond reasonable control, provided that written notice is given within 48 hours of the occurrence.
- Amendments: No modification to this Purchase Order shall be valid unless executed in writing and signed by both the authorized representative of the Directorate of Secondary and Higher Education, Dhaka, and the Supplier.
