The following additional costs are not included in the above Quotation Estimate and will be billed separately at actual cost, subject to prior written approval by the client:
• Court filing fees (Gerichtskosten) as determined by the German Courts and Notaries Cost Act (GKG): estimated €1,500.00 – €3,000.00 depending on the value in dispute.
• Costs for court-appointed experts (Sachverständigenkosten), if applicable: estimated €800.00 – €2,000.00.
• Travel expenses within Munich and the surrounding Bavaria region (e.g., to court hearings, notary offices, or client meetings): calculated at €0.35 per km plus parking and public transport costs.
• Costs for certified copies, document reproduction, and international mail: at actual cost.
• Fees for a second Lawyer (Ersatzanwalt) in case of conflict of interest or unavailability: to be agreed separately.
3.1 Validity. This Quotation Estimate is valid for a period of thirty (30) calendar days from the date of issue. After expiry, the Lawyer reserves the right to revise the fees based on current market rates and the German Lawyers' Fee Act (Rechtsanwaltsvergütungsgesetz – RVG).
3.2 Payment Terms. Invoices issued pursuant to this Quotation Estimate are payable within fourteen (14) calendar days of the invoice date to the bank account of Hofmann & Partner Rechtsanwälte mbB, IBAN: DE89 7507 0024 0000 1234 56, BIC: DEUTDEMM750, Munich, Germany. Late payments shall accrue statutory interest at the rate of 5 percentage points above the ECB base rate.
3.3 Retainer Fee. A retainer fee (Vorauszahlung) of 30% of the total estimated net fee (i.e., €3,627.00) is due upon acceptance of this Quotation Estimate and prior to the commencement of any legal work. The retainer shall be credited against the final invoice.
3.4 Fee Adjustments. The fees set out in this Quotation Estimate are estimates based on the current scope of work. Should the legal matter in Munich, Germany, expand in complexity or duration beyond the originally anticipated scope, the Lawyer shall notify the client in writing and issue a revised Quotation Estimate before proceeding with additional work.
3.5 Professional Indemnity Insurance. The Lawyer maintains professional indemnity insurance (Berufshaftpflichtversicherung) in accordance with the requirements of the German Lawyers' Professional Rules (Berufsordnung für Rechtsanwälte – BORA), with a minimum coverage of €1,000,000 per claim and €2,000,000 in the aggregate.
3.6 Data Protection. All personal data processed in connection with this Quotation Estimate and the subsequent legal engagement shall be handled in strict compliance with the European General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (Bundesdatenschutzgesetz – BDSG). The client's data shall be stored securely in Munich, Germany, and shall not be transferred to third parties without explicit consent, except where required by law.
3.7 Governing Law and Jurisdiction. This Quotation Estimate and any resulting legal engagement shall be governed by the laws of the Federal Republic of Germany. The exclusive jurisdiction for any disputes arising herefrom shall be the competent courts in Munich, Germany.
3.8 Acceptance. This Quotation Estimate does not constitute a binding engagement until it is countersigned by the client and returned to the Lawyer's office in Munich. Upon acceptance, a formal retainer agreement (Mandatsvertrag) in accordance with § 518 of the German Civil Code (BGB) shall be concluded.
