This Quotation Estimate is issued by Van der Merwe & Associates Attorneys, a registered law firm practising in Cape Town, South Africa, in response to the client's request for a detailed cost assessment of legal representation. As a Lawyer operating within the jurisdiction of the Western Cape High Court and the Cape Town Magistrates' Court, our firm is committed to providing transparent, itemised fee structures in full compliance with the Legal Practice Council (LPC) regulations and the National Rules of the Legal Profession applicable in South Africa.
This Quotation Estimate sets out the anticipated costs, disbursements, and professional fees associated with the legal matter described herein. It is important to note that this document constitutes an estimate only and does not form a binding contract until formally accepted in writing by the client. All fees quoted are exclusive of Value Added Tax (VAT) at the prevailing rate of 15% as applicable in South Africa.
The Lawyer and legal team engaged under this Quotation Estimate shall provide the following services in connection with the client's commercial dispute matter (Case No. 2025/CT/03421, Cape Town High Court):
- Drafting and filing of a Notice of Motion and supporting affidavit before the Cape Town High Court;
- Preparation of a comprehensive legal opinion on the enforceability of the relevant commercial agreement;
- Representation at all pre-trial conferences, case management conferences, and the main trial;
- Negotiation of a settlement or consent order, should the opposing party agree to resolve the matter out of court;
- Post-judgment enforcement proceedings, including the execution of a writ of execution if necessary;
- General legal correspondence, advice, and consultation with the client throughout the duration of the matter.

The following payment terms apply to this Quotation Estimate for legal services rendered in Cape Town, South Africa:
- Retainer Fee: A non-refundable retainer of R 50,000 (fifty thousand Rand) is payable within seven (7) business days of acceptance of this Quotation Estimate. This retainer will be credited against the final account.
- Progress Payments: Monthly account statements will be rendered by the Lawyer's firm on the last working day of each calendar month. Payment is due within fourteen (14) days of receipt of each account.
- Final Account: A final account, including all disbursements and professional fees, will be rendered within thirty (30) days of the conclusion of the matter. Payment of the final account is due within fourteen (14) days.
- Interest on Overdue Amounts: In the event of non-payment, interest shall accrue at the rate of 10% per annum, compounded monthly, in accordance with the Legal Practice Act 28 of 2014 (South Africa).
- Costs of Recovery: Should the firm be required to institute debt collection proceedings to recover outstanding fees, the client shall be liable for all costs of recovery on an attorney-and-client scale.
This Quotation Estimate is valid for a period of thirty (30) days from the date of issue. Should the client wish to proceed after the expiry date, the firm reserves the right to revise the fees based on prevailing market rates in Cape Town and any changes in court fees gazetted by the Department of Justice and Constitutional Development of South Africa.
The estimates provided herein are based on the information available to the Lawyer at the time of drafting. Should the scope of the matter expand, or should unforeseen procedural complications arise during litigation in the Cape Town courts, the firm will issue a revised Quotation Estimate or a supplementary account with prior written notice to the client.
This Quotation Estimate does not constitute a guarantee of outcome. The Lawyer and firm make no representation or warranty regarding the result of the legal proceedings. All legal matters are subject to the discretion of the court and the applicable laws of the Republic of South Africa.
This Quotation Estimate and any resulting attorney-client relationship shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or in connection with this Quotation Estimate shall be subject to the exclusive jurisdiction of the High Court of South Africa, Western Cape Division, Cape Town.
By signing below, the client acknowledges receipt of this Quotation Estimate, confirms that the scope of services and fee structure have been explained and understood, and authorises the Lawyer and firm to proceed with the legal matter as described herein.
