Terms and Conditions of This Invoice
- This Invoice is issued by the undersigned Judge in her capacity as a retired judicial officer providing arbitration and mediation services in Nairobi, Kenya, in accordance with the Arbitration Act, 1995 (Cap 49) and the rules of the Nairobi International Arbitration Centre.
- All services rendered by the Judge are subject to the Code of Conduct for Judicial Officers of Kenya and the principles of natural justice, impartiality, and due process.
- The amounts stated in this Invoice are exclusive of any travel, accommodation, or per diem expenses incurred by the Judge while performing duties in Nairobi or its environs, which shall be reimbursed at actual cost upon submission of receipts.
- VAT is charged at the prevailing rate of 16% as determined by the Kenya Revenue Authority. Withholding tax of 5% has been deducted at source in compliance with the Income Tax Act, 2015.
- This Invoice constitutes a final and binding statement of fees for the services described herein. Any disputes regarding the amounts invoiced shall be resolved through the Nairobi Small Claims Court or by mutual agreement of the parties.
- The client acknowledges that the Judge's professional judgment, rulings, and the arbitral award are final and binding, subject only to the limited grounds for challenge provided under Section 45 of the Arbitration Act, 1995.
- Confidentiality: All documents, records, and information pertaining to the case referenced in this Invoice shall be treated as strictly confidential in accordance with the Kenya Data Protection Act, 2019, and the rules of the arbitral institution.
- This Invoice is valid for a period of ninety (90) days from the date of issue. Thereafter, the client shall be required to request a re-issued Invoice reflecting any applicable tax rate changes.
