Payment Terms & Conditions of This Invoice

  1. This Invoice must be settled in full within thirty (30) calendar days from the date of issue, i.e., no later than 15 July 2025. Payment is to be made by electronic funds transfer (EFT) to the bank account details specified above, or by cheque payable to "Van der Merwe & Associates Attorneys" and delivered to our Cape Town office.
  2. Should payment not be received by the due date, interest will accrue on the outstanding balance at the rate of 10% per annum, calculated on a daily basis, in terms of Section 76 of the National Credit Act 34 of 2005 and the terms of our retainer agreement.
  3. This Invoice constitutes a formal demand for payment of professional legal fees and expenses incurred by the Lawyer in rendering services to the client. The client acknowledges that the fees charged are reasonable and in accordance with the tariff approved by the Law Society of Cape Town.
  4. In the event of non-payment within the stipulated period, the Lawyer reserves the right to suspend all further legal work on the matter, to withdraw from the matter in terms of the Legal Profession Act 54 of 2014, and to refer the outstanding debt for collection through the Cape Town Magistrate's Court or the High Court of South Africa, Cape Town Division, as appropriate.
  5. All legal advice, documents, and work product generated in connection with this matter remain the intellectual property of the Lawyer and the firm. The client is granted a limited licence to use such materials solely for the purpose of the litigation in question.
  6. This Invoice is governed by the laws of the Republic of South Africa. Any dispute arising from or in connection with this Invoice shall be subject to the exclusive jurisdiction of the courts of Cape Town, Western Cape, South Africa.
  7. The client is advised to retain this Invoice for their personal tax records. A VAT-registered Lawyer in South Africa is required to issue a tax invoice in compliance with SARS regulations. This document serves as the official tax invoice for the services rendered.
