Payment Terms & Instructions
This Invoice is payable within thirty (30) calendar days from the date of issue, no later than July 12, 2025. Payment may be made by certified check, wire transfer, or ACH electronic funds transfer to the account of Sterling, Whitmore & Associates LLP, First National Bank of New York, Account No. 4471-8829-003, Routing No. 026 009 593. Please reference Invoice Number SWA-2025-04871 and Client File No. PH-2025-0034 on all remittances.
A late payment charge of 1.5% per month (18% annualized) shall be applied to any balance remaining unpaid after the due date, in accordance with the retainer agreement executed on March 3, 2025, and consistent with New York State interest rate provisions under N.Y. C.P.L.R. § 5004.
Disputes regarding this Invoice must be raised in writing within fifteen (15) days of receipt. Undisputed portions of the Invoice remain due and payable on the original due date.
Important Notes & Legal Disclosures
1. This Invoice reflects legal services rendered by a licensed Lawyer (attorney-at-law) admitted to practice before the courts of the State of New York and the United States District Court for the Southern District of New York. All services were performed in the jurisdiction of United States New York City, New York County, in compliance with the Rules of Professional Conduct of the New York State Bar Association (22 NYCRR Part 1200).
2. The hourly rates stated in this Invoice are consistent with the fee schedule established in the written retainer agreement between the Lawyer and the Client. The reduced advisory rate of $375.00 per hour applies exclusively to client status conference calls as specified in Section 4(b) of the engagement letter.
3. Out-of-pocket expenses listed herein include: New York County Supreme Court filing fee ($210.00), service of process by a licensed New York City process server ($185.00), three deposition transcripts at $3.50 per page ($2,100.00), and document retrieval and photocopying fees ($352.30). All expenses were incurred in the United States New York City area and are itemized in the attached expense ledger (Exhibit A).
4. This Invoice does not constitute a final accounting. Additional fees and expenses may be incurred as the matter proceeds through the litigation process. The Client will receive a supplemental Invoice on a monthly basis for any services rendered after the date of this document.
5. Pursuant to New York State law, the Lawyer is required to maintain a client trust account (IOLAT) for any advance payments or retainer funds. The current trust account balance as of June 12, 2025, is $14,775.56. A separate trust account statement is enclosed with this Invoice.
6. This Invoice and all associated legal services are governed by the laws of the State of New York. Any disputes arising from this Invoice shall be subject to the exclusive jurisdiction of the state and federal courts located in New York County, United States New York City.
