This Purchase Order is issued by the Kabul Municipal Development Authority to engage the services of a licensed Architect for the comprehensive design, planning, and technical supervision of the new Kabul Central Community Health Facility. The Architect shall be responsible for all phases of architectural design, from initial concept development through to final construction documentation, in full compliance with the building codes and regulations applicable in Afghanistan Kabul. Payment for the architectural services outlined in this Purchase Order shall be made in accordance with the following schedule, subject to satisfactory completion and acceptance of each deliverable by the Buyer's designated project manager in Kabul:
- 20% advance payment (AFN 1,750,000) upon execution of this Purchase Order and submission of the Architect's performance bond.
- 25% milestone payment (AFN 2,187,500) upon approval of the schematic design package.
- 30% milestone payment (AFN 2,625,000) upon approval of the full construction documentation set.
- 15% progress payments (AFN 225,000 per month) during the construction supervision phase, payable monthly upon submission of the Architect's site report.
- 10% final payment (AFN 875,000) upon completion of as-built documentation and final handover.
All payments shall be made via bank transfer to the Architect's designated account in Kabul, Afghanistan. The Buyer reserves the right to withhold payment for any deliverable that does not meet the specifications outlined in this Purchase Order.
- This Purchase Order is governed by the laws of the Islamic Republic of Afghanistan. Any disputes arising from this Purchase Order shall be resolved through arbitration in Kabul, Afghanistan, in accordance with the Afghan Commercial Arbitration Law.
- The Architect warrants that all services rendered under this Purchase Order shall be performed in a professional and workmanlike manner, consistent with the standards of practice for licensed Architects in Afghanistan Kabul.
- The Architect shall maintain professional liability insurance with a minimum coverage of AFN 10,000,000 for the duration of the project.
- All architectural drawings, designs, and documentation produced under this Purchase Order shall become the exclusive property of the Buyer upon full payment.
- The Architect shall comply with all applicable building regulations, zoning ordinances, and environmental standards in force in Kabul, Afghanistan at the time of design and construction.
- Time is of the essence. The Architect shall adhere to the project schedule attached as Annex A to this Purchase Order. Delays exceeding 15 working days without written approval from the Buyer shall incur a penalty of 0.5% of the total Purchase Order value per week of delay.
- This Purchase Order may be amended only by mutual written agreement of both parties, executed in the form of a formal amendment document.
- The Architect shall not subcontract any portion of the architectural services without prior written consent from the Buyer.
Important: The Architect acknowledges that this project is located in Kabul, Afghanistan, and is aware of the specific regulatory environment, including the requirement for approval from the Kabul Municipality Building Department and the Ministry of Urban Development and Reconstruction. All architectural submissions must be in both Dari and English. The Architect shall coordinate with local authorities in Kabul for all permit applications and inspections. The Architect further acknowledges the seismic zone classification of the Kabul region and shall ensure all designs meet the enhanced seismic design criteria mandated for critical infrastructure in Afghanistan.
By signing below, both parties acknowledge and agree to all terms, conditions, and obligations set forth in this Purchase Order for the procurement of Architect services in Afghanistan Kabul. This Purchase Order constitutes a binding agreement upon execution by both authorized representatives.
