All items listed in Section 4 shall be delivered to the Kinshasa Astronomical Research Institute, Avenue de l'Observatoire, Commune de Gombe, DR Congo Kinshasa, no later than 30 November 2025. The supplier is responsible for all packaging, crating, and transport to the port of N'djili, Kinshasa. Installation, alignment, and initial calibration of the telescope and spectrograph for the Astronomer shall be completed by the supplier's certified engineers within thirty (30) calendar days of delivery. The Astronomer, Dr. Amara Kintu, shall be present during all installation and commissioning activities to verify operational readiness.

- This Purchase Order is governed by the laws of the Democratic Republic of the Congo and, where applicable, the United Nations Convention on Contracts for the International Sale of Goods (CISG).
- All equipment must be new, unused, and of current production. No refurbished or second-hand components shall be accepted by the Astronomer or the purchasing authority.
- The supplier warrants that all items are free from defects in material and workmanship for a period of twenty-four (24) months from the date of acceptance in DR Congo Kinshasa.
- Intellectual property in any custom software or firmware delivered with the equipment shall be licensed to the Astronomer and NOCK-ARI for unlimited internal research use.
- Disputes arising from this Purchase Order shall be resolved by arbitration in Kinshasa, DR Congo Kinshasa, under the rules of the ICC, with proceedings conducted in English.
- The supplier shall provide full technical documentation, user manuals, and training materials in English and French for the Astronomer's use.
- Force majeure events, including but not limited to port closures at N'djili or national emergencies in DR Congo Kinshasa, shall extend delivery timelines by a period equivalent to the duration of the event.
This Purchase Order is issued and authorised by the undersigned on behalf of the National Observatory of the Congo – Kinshasa Astronomical Research Institute, for the procurement of astronomical research equipment for the Astronomer, Dr. Amara Kintu, to be deployed and operated at the institute's facility in DR Congo Kinshasa.
