  1. Governing Law: This Purchase Order is governed by and shall be construed in accordance with the laws of the State of Queensland, Australia. Any disputes arising from this Purchase Order shall be resolved in the courts of Brisbane, Queensland, Australia.
  2. Scope of Work: The Biomedical Engineer engaged under this Purchase Order shall perform all duties in strict compliance with the Australian Therapeutic Goods Act 1989, the Queensland Health Act 1991, and all applicable Australian Standards (AS/NZS) pertaining to medical device safety and performance.
  3. Qualifications: The Biomedical Engineer must hold a minimum of a Bachelor of Engineering (Biomedical) or equivalent qualification accredited by Engineers Australia, a valid Australian working visa or citizenship, and a current National Police Check. Proof of qualifications must be submitted prior to commencement of services in Brisbane.
  4. Payment Terms: Payment shall be made within 30 days of receipt of a valid tax invoice. Invoices must reference this Purchase Order number (PO-2025-BME-04872). Payment will be processed via electronic funds transfer (EFT) to the supplier's nominated Australian bank account.
  5. Performance Bond: The supplier shall provide a performance bond equivalent to 10% of the total Purchase Order value, to be held by Queensland Health, Brisbane, and released upon satisfactory completion of all deliverables.
  6. Confidentiality: The Biomedical Engineer and all associated personnel shall maintain strict confidentiality regarding patient data, hospital systems, and proprietary information in accordance with the Privacy Act 1988 (Cth) and the Information Privacy Act 2009 (Qld).
  7. Insurance: The supplier must maintain, at its own cost, professional indemnity insurance of no less than AUD $10,000,000 and public liability insurance of no less than AUD $20,000,000, with Queensland Health, Brisbane, named as an additional insured party.
  8. Termination: Either party may terminate this Purchase Order with 30 days written notice. Queensland Health, Brisbane, reserves the right to terminate immediately for material breach, non-compliance with Australian regulatory requirements, or failure to meet performance benchmarks.
  9. Intellectual Property: All reports, plans, and documentation produced by the Biomedical Engineer specifically for the Brisbane Regional Medical Centre under this Purchase Order shall remain the property of Queensland Health.
  10. Compliance: The supplier warrants that all services rendered by the Biomedical Engineer shall comply with the Australian Consumer Law, the Competition and Consumer Act 2010 (Cth), and all applicable Queensland state regulations.
