3. Scope of Purchase — Biomedical Engineer Services

This Purchase Order is issued by CHU de Marseille to formally engage the services of a qualified Biomedical Engineer to be deployed at the France Marseille hospital campus. The engagement of this Biomedical Engineer is intended to support the ongoing modernization of medical imaging equipment, diagnostic laboratory instrumentation, and patient monitoring systems across all clinical wards. The Biomedical Engineer shall be responsible for the installation, calibration, preventive maintenance, and troubleshooting of all Class IIa and Class IIb medical devices as defined under the European Medical Devices Regulation (EU) 2017/745, which is fully applicable within France Marseille and the broader Provence-Alpes-Côte d'Azur region.

The selected Biomedical Engineer must hold a minimum of a Master's degree in Biomedical Engineering (Diplôme d'Ingénieur in Génie Biomédicale) from an accredited French or European institution, and must possess at least five (5) years of documented professional experience in hospital biomedical engineering. Fluency in both French and English is mandatory, as all technical documentation, regulatory filings, and inter-departmental communications within the France Marseille facility are conducted in both languages. 5. Terms and Conditions
  1. Commencement and Duration: The services of the Biomedical Engineer shall commence on 1 September 2025 at the France Marseille hospital campus and shall continue for a period of twelve (12) months, subject to mutual renewal by written agreement. This Purchase Order constitutes the binding contractual framework for the entire engagement period.
  2. Payment Terms: Payment shall be made in quarterly installments of EUR 29,505.00 (inclusive of VAT), due within thirty (30) calendar days of the invoice date. The first installment is due upon successful onboarding and site induction of the Biomedical Engineer at the France Marseille location. All payments shall be processed via SEPA bank transfer to the account designated by MedTech Solutions Europe SARL.
  3. Performance Standards: The Biomedical Engineer shall adhere to all applicable French national standards (NF), European harmonized standards (EN), and the specific technical protocols established by CHU de Marseille. Failure to meet the performance benchmarks outlined in Annex A of this Purchase Order shall entitle the Buyer to issue a formal notice of non-conformity, with a remediation period of fifteen (15) business days.
  4. Regulatory Compliance in France Marseille: The Biomedical Engineer shall ensure that all maintenance, calibration, and repair activities comply with the French Public Health Code (Code de la santé publique), the European Medical Devices Regulation, and the specific directives issued by the Agence Nationale de Sécurité du Médicament (ANSM).   5.
