Scope of Work & Itemised Purchase Order DetailsThis Purchase Order is issued by Birmingham University Hospitals NHS Foundation Trust to procure the professional services of a qualified Biomedical Engineer along with associated equipment, calibration tools, and technical documentation. All services and deliverables shall be performed and delivered within United Kingdom Birmingham in strict compliance with NHS procurement regulations, the UK Medical Devices Regulations 2002 (SI 617), and the Health and Safety at Work etc. Act 1974. The appointed Biomedical Engineer shall hold a valid Engineering Council (EngC) or Institution of Engineering and Technology (IET) membership and demonstrate a minimum of eight (8) years of post-qualification experience in clinical biomedical engineering within a UK hospital environment.

- This Purchase Order constitutes a binding agreement between the Purchasing Entity and the Supplier upon signature by both parties. All terms are governed by the laws of England and Wales, applicable within United Kingdom Birmingham and the wider United Kingdom jurisdiction.
- The Biomedical Engineer appointed under this Purchase Order shall be fully indemnified and insured for a minimum of £10,000,000 in professional liability cover, with certificates of insurance provided prior to commencement of duties in Birmingham, United Kingdom.
- All equipment and materials procured under this Purchase Order must comply with the UK Medical Devices Regulations 2002, the UK General Product Safety Regulations 2005, and applicable IEC 60601-1 safety standards. The Biomedical Engineer shall verify compliance prior to installation at any site within United Kingdom Birmingham.
- Payment shall be made within thirty (30) calendar days of receipt of a valid tax invoice. Late payments shall accrue interest at the rate prescribed by the Late Payment of Commercial Debts (Interest) Act 1998.
- The Supplier warrants that the Biomedical Engineer shall maintain all necessary professional registrations, including IET membership, EngC chartered status (where applicable), and any NHS-specific clinical engineering certifications required for practice in United Kingdom Birmingham.
- Confidentiality: All patient data, clinical records, and proprietary hospital information accessed by the Biomedical Engineer in the course of this Purchase Order shall be treated as strictly confidential in accordance with the UK Data Protection Act 2018 and the GDPR as retained in UK law.
- Termination: Either party may terminate this Purchase Order with thirty (30) days written notice. In the event of termination, the Biomedical Engineer shall complete all in-progress calibration and maintenance tasks at the Birmingham site before handover.
- Dispute Resolution: Any disputes arising from this Purchase Order shall first be subject to mediation in Birmingham, United Kingdom. If unresolved, matters shall be referred to the courts of England and Wales.
- This Purchase Order supersedes all prior quotations, verbal agreements, and correspondence between the parties regarding the procurement of Biomedical Engineer services in United Kingdom Birmingham.
