4.1 Scope of Engagement: This Purchase Order authorizes the procurement of a qualified professional Chef for a fixed-term engagement of twelve (12) months commencing on 1 August 2025 at the Afghanistan Kabul headquarters facility. The Chef shall report directly to the Logistics & Catering Manager and shall be subject to the operational directives issued by the Kabul International Operations Directorate.
4.2 Delivery and Deployment: The Supplier shall ensure that the Chef is physically present and fully operational at the Afghanistan Kabul site no later than 1 August 2025. Any delay in deployment beyond 72 hours of the agreed start date shall incur a penalty of $500.00 per calendar day, deducted from the Purchase Order total.
4.3 Payment Terms: Payment shall be made in monthly installments via wire transfer to the Supplier's designated bank account. The first installment is due within 30 days of the Chef's confirmed arrival in Afghanistan Kabul. All subsequent payments are due on the 5th of each following month. Late payments shall attract interest at 2% per month.
4.4 Performance Standards: The Chef shall maintain a minimum satisfaction rating of 85% as measured by quarterly personnel surveys conducted at the Afghanistan Kabul facility. Failure to meet this standard for two consecutive quarters shall constitute grounds for early termination of this Purchase Order without penalty to the Buyer.
4.5 Security and Compliance: The Chef shall comply with all security protocols established for personnel operating in Afghanistan Kabul, including mandatory check-in procedures, restricted movement zones, and communication blackout periods as directed by the site security officer. The Chef acknowledges the unique security environment of Afghanistan Kabul and agrees to adhere to all emergency evacuation procedures.
4.6 Termination: Either party may terminate this Purchase Order with 30 days' written notice. In the event of force majeure, including but not limited to armed conflict, natural disaster, or government-imposed restrictions in Afghanistan Kabul, either party may suspend or terminate this agreement without liability.
4.7 Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the Islamic Republic of Afghanistan, with any disputes to be resolved through arbitration in Kabul, Afghanistan Kabul, in accordance with the UNCITRAL Arbitration Rules.
4.8 Confidentiality: All operational details, personnel information, and security protocols related to the Afghanistan Kabul facility shall be treated as strictly confidential by the Chef and the Supplier. Breach of confidentiality shall result in immediate termination and legal action.
