- This Purchase Order is governed by the laws of the Republic of the Union of Myanmar. Any disputes arising from this Purchase Order shall be resolved through arbitration in Myanmar Yangon in accordance with the Myanmar Arbitration Law.
- The Civil Engineer shall maintain valid professional registration with the Myanmar Engineers Council throughout the entire project duration. Failure to maintain licensure shall constitute grounds for immediate termination of this Purchase Order.
- All structural designs and engineering deliverables must comply with the Myanmar Building Code (MBC 2020), the Yangon City Development Committee (YCDC) regulations, and applicable national standards for seismic and wind loading in the Myanmar Yangon region.
- Payment shall be made in three milestones: 30% upon approval of design documents, 50% upon completion of on-site supervision (Week 12), and 20% upon submission of the final as-built report. All payments shall be processed in Myanmar Kyat (MMK) via bank transfer to the account specified by the vendor.
- The Civil Engineer shall provide weekly progress reports every Friday to the Project Director at Golden Pagoda Infrastructure. Monthly consolidated reports shall be submitted to the Myanmar Yangon project office by the 5th of each following month.
- All intellectual property, design drawings, and engineering documentation produced under this Purchase Order shall become the sole property of Golden Pagoda Infrastructure & Construction Co., Ltd. upon full payment.
- The vendor shall carry professional indemnity insurance with a minimum coverage of 500,000,000 MMK for the duration of the engagement. A certificate of insurance must be provided prior to commencement of work.
- Any changes in scope, additional structural elements, or extended supervision beyond the 16-week period shall require a written amendment to this Purchase Order signed by both parties before work proceeds.
- The Civil Engineer is responsible for ensuring that all on-site activities comply with Myanmar occupational health and safety regulations. The vendor shall provide all necessary personal protective equipment for their team members at the Myanmar Yangon project site.
- This Purchase Order is valid for acceptance within 10 business days of the issue date. Failure to accept within this period shall render this Purchase Order null and void.
