- This Purchase Order is issued by the Federal Infrastructure Development Agency (FIDA) for the procurement of professional Civil Engineer services for the Gwagwalada Axis Road Expansion project located in Abuja, FCT, Nigeria. The supplier shall perform all services in strict compliance with the scope of work outlined herein.
- All Civil Engineer personnel engaged under this Purchase Order must hold valid Professional Engineers (P.Eng.) registration with the Council for the Regulation of Engineering in Nigeria (COREN) and possess a minimum of ten (10) years of relevant experience in highway and infrastructure engineering within Nigeria, Abuja, and the Federal Capital Territory.
- The supplier shall submit a detailed project execution plan within seven (7) working days of the commencement date. All deliverables, including structural drawings, geotechnical reports, BOQ documents, and supervision reports, shall be submitted to the FIDA Civil Engineering Division at its headquarters in the Central Business District, Abuja, Nigeria.
- Payment shall be made in Nigerian Naira (NGN) via bank transfer to the supplier's designated account within thirty (30) days of receipt of a valid tax invoice and certified completion report from the supervising Civil Engineer. The Federal Government of Nigeria shall withhold tax at the statutory rate of five percent (5%) as applicable under the Nigerian tax regime.
- The supplier shall maintain comprehensive professional indemnity insurance coverage of not less than NGN 50,000,000.00 for the duration of this Purchase Order. Certificates of insurance shall be provided to FIDA prior to commencement of any Civil Engineer services in Abuja, Nigeria.
- All work performed under this Purchase Order shall comply with the Nigerian Building Code, the Federal Capital Development Authority (FCDA) planning guidelines, and all applicable regulations of the Federal Ministry of Works and Housing, Nigeria, Abuja.
- The supplier shall not sublet or assign any portion of the Civil Engineer services specified in this Purchase Order without prior written consent from the FIDA Procurement Department, Abuja, Nigeria.
- In the event of default or failure to meet the completion deadline, the supplier shall be liable to liquidated damages at the rate of NGN 250,000.00 per day of delay, in addition to any other remedies available to FIDA under Nigerian contract law.
- This Purchase Order shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from this Purchase Order shall be resolved through arbitration in Abuja, FCT, Nigeria, in accordance with the Arbitration and Conciliation Act, Cap A18, Laws of the Federation of Nigeria 2004.
- All intellectual property, reports, drawings, and documentation produced by the Civil Engineer under this Purchase Order shall become the exclusive property of the Federal Infrastructure Development Agency upon full payment.
