This Purchase Order is issued by the West Midlands Infrastructure Development Authority to procure the professional services of a qualified Civil Engineer and associated civil engineering works for the Canal Street Corridor regeneration project situated in the heart of Birmingham, United Kingdom. The Civil Engineer shall be responsible for the full design, specification, supervision, and quality assurance of all civil engineering elements of the project in strict compliance with UK Building Regulations, the Town and Country Planning Act 1990, and all applicable Birmingham City Council planning conditions.

The Civil Engineer shall ensure that all structural, geotechnical, drainage, and earthworks design elements meet the standards set out in BS EN 1990 (Eurocode – Basis of Structural Design), BS 8002 (Code of Practice for Geotechnical Design), and the specific requirements of the Birmingham City Council Highways Department. All works shall be executed within the designated construction zone on Canal Street, Birmingham, and shall not impede public access to the adjacent Brindley Place retail district for a period exceeding four consecutive hours on any given working day.

  1. This Purchase Order is governed by the laws of England and Wales. Any disputes arising from this Purchase Order shall be subject to the exclusive jurisdiction of the courts of Birmingham, United Kingdom.
  2. The Civil Engineer shall hold a minimum of £10,000,000 in professional indemnity insurance and £5,000,000 in public liability insurance, with certificates of cover to be provided prior to commencement of works in Birmingham.
  3. All design documentation produced by the Civil Engineer shall be submitted in accordance with the BIM (Building Information Modelling) requirements set out in the Government Construction White Paper and Birmingham City Council's Digital Delivery Framework.
  4. The Civil Engineer shall comply with all health and safety legislation, including the Construction (Design and Management) Regulations 2015 (CDM 2015), and shall appoint a competent Principal Designer where required for the Birmingham site.
  5. Payment shall be made by BACS transfer to the account nominated by the Civil Engineer within thirty (30) calendar days of receipt of a valid VAT invoice. Late payment interest shall accrue at the rate prescribed by the Late Payment of Commercial Debts (Interest) Act 1998.
  6. The Civil Engineer shall not subcontract any portion of the professional design services without the prior written consent of the West Midlands Infrastructure Development Authority. All site-based supervision must be carried out by a Chartered Civil Engineer (CEng, MICE or MIStructE) registered with the Institution of Civil Engineers.
  7. Any variation to the scope of civil engineering works must be agreed in writing via a formal Variation Order prior to execution. No additional costs shall be incurred without prior authorisation under this Purchase Order.
  8. The Civil Engineer warrants that all design calculations, specifications, and recommendations shall be fit for purpose and shall comply with the current edition of all relevant British Standards and Eurocodes applicable to civil engineering works in the United Kingdom.
  9. Confidentiality: All project data, site surveys, and design information pertaining to this Birmingham regeneration scheme shall be treated as confidential and shall not be disclosed to third parties without written consent, in accordance with the UK Data Protection Act 2018 and the UK GDPR.
  10. This Purchase Order may be terminated by either party with fourteen (14) days' written notice in the event of material breach, insolvency, or force majeure. Upon termination, the Civil Engineer shall be compensated for all work satisfactorily completed up to the date of termination.

This Purchase Order is issued and authorised by the undersigned on behalf of the West Midlands Infrastructure Development Authority. Acceptance of this Purchase Order by the Civil Engineer constitutes full agreement to all terms, conditions, and specifications set out herein.
