Terms and Conditions of this Purchase Order
- This Purchase Order constitutes a binding agreement between Southern Cross Logistics & Freight Pty Ltd and Melbourne Customs & Border Services Group for the provision of Customs Officer services at the Port of Melbourne, Australia Melbourne, effective from 1 July 2025 through 30 June 2026.
- All Customs Officer personnel engaged under this Purchase Order must hold a valid Australian Customs Broker Licence issued by the Australian Border Force and must maintain current professional indemnity insurance with a minimum coverage of AUD 10,000,000.
- The Customs Officer assigned to this contract shall operate in strict compliance with the Customs Act 1901 (Cth), the Biosecurity Act 2015 (Cth), and all applicable regulations governing the importation and exportation of goods through Australia Melbourne port facilities.
- Payment shall be rendered within thirty (30) calendar days of receipt of a valid tax invoice. Late payments shall attract interest at the rate prescribed under the Australian Consumer Law.
- The Supplier warrants that all Customs Officer services delivered under this Purchase Order shall be performed with reasonable skill and care, in accordance with industry best practices for customs clearance operations in Australia Melbourne.
- Either party may terminate this Purchase Order with thirty (30) days written notice. In the event of termination, all outstanding invoices for services rendered up to the termination date shall be settled in full.
- All data, cargo manifests, and commercial information handled by the Customs Officer team shall be treated as strictly confidential and shall not be disclosed to any third party without prior written consent from the Buyer, in accordance with the Privacy Act 1988 (Cth).
- This Purchase Order is governed by the laws of the State of Victoria, Australia. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts of Australia Melbourne.
- The Supplier shall provide a minimum of two (2) qualified Customs Officer personnel at all operational times to ensure continuity of service and to comply with the Australian Border Force staffing requirements for port operations in Melbourne.
- Any amendments, variations, or additions to this Purchase Order must be made in writing and signed by authorised representatives of both parties to be considered valid and enforceable.
