1. Delivery Schedule: All goods specified in this Purchase Order shall be delivered to the designated locations within Accra, Ghana, no later than thirty (30) calendar days from the date of this Purchase Order. The supplier shall coordinate delivery logistics with the undersigned Customs Officer to ensure minimal disruption to ongoing customs operations at the Tema Port and Accra International Airport.
2. Payment Terms: Payment shall be made via bank transfer to the supplier's designated account within fifteen (15) business days of successful delivery and inspection of all goods by the Customs Officer procurement team. A 10% retention shall be held for a period of ninety (90) days to guarantee product performance and warranty compliance.
3. Quality Assurance: All equipment must meet the specifications outlined in the Ghana Revenue Authority Customs Division technical standards. The Customs Officer responsible for this Purchase Order reserves the right to reject any item that does not conform to the agreed specifications. Rejected items must be replaced within seven (7) business days at the supplier's sole expense.
4. Warranty: The supplier shall provide a minimum two-year comprehensive warranty on all electronic and mechanical equipment. Uniforms shall carry a six-month workmanship warranty. Any defects discovered during the warranty period shall be repaired or replaced at no additional cost to the Customs Division.
5. Compliance with Ghanaian Law: This Purchase Order is governed by the laws of the Republic of Ghana, including the Public Procurement Act, 2003 (Act 663) and its amendments. The supplier warrants that all goods are legally imported or manufactured in Ghana and comply with all applicable regulations of the Ghana Revenue Authority, the Standards Authority of Ghana, and the National Communications Authority.
6. Confidentiality: The supplier acknowledges that this Purchase Order relates to sensitive customs operations. All information pertaining to the nature, quantity, and deployment of the procured equipment shall be treated as confidential and shall not be disclosed to any third party without the written consent of the issuing Customs Officer and the Director of Customs, Accra.
7. Dispute Resolution: Any disputes arising from this Purchase Order shall be resolved through mediation in Accra, Ghana, in accordance with the provisions of the Ghana Arbitration Act, 2010 (Act 798). The courts of Accra shall have exclusive jurisdiction.
8. Validity: This Purchase Order is valid for a period of sixty (60) days from the date of issue. Failure to accept this Purchase Order within the stated period shall render it null and void, and the Customs Officer may reissue the procurement through alternative means.
