2. TERMS AND CONDITIONS

This Purchase Order is issued in accordance with the Government of India's General Financial Rules (GFR) 2017 and the CBIC procurement guidelines applicable to customs operations in India Bangalore. The Seller acknowledges and agrees to all terms stated herein.
The Customs Officer engaged under this Purchase Order shall hold a valid appointment letter issued by the CBIC, possess a minimum of 5 years of experience in customs clearance operations, and be proficient in the ICEGATE (Indian Customs Electronic Gateway and Tracking) system used at all India Bangalore customs checkpoints.
All services and equipment procured under this Purchase Order shall be delivered to the Customs House, MG Road, Bengaluru (Bangalore), Karnataka – 560001, India. The Seller shall bear all transportation and installation costs within the India Bangalore metropolitan area.
Payment shall be made via RTGS/NEFT to the Seller's designated bank account within 30 days of receipt of a valid tax invoice and satisfactory completion of the service or delivery of goods. The Purchase Order number PO/CUS/BLR/2025/04782 must be referenced on all invoices.
The Customs Officer shall be bound by the Official Secrets Act, 1923, and the Customs Act, 1962. Any breach of confidentiality regarding cargo manifests, duty assessments, or trade data handled at the India Bangalore customs facility shall result in immediate termination of this Purchase Order and legal proceedings.
The Seller warrants that all equipment and software provided shall be free from defects, fully compliant with BIS (Bureau of Indian Standards) specifications, and shall carry a minimum warranty period of 24 months from the date of installation in India Bangalore.
This Purchase Order shall be governed by and construed in accordance with the laws of India. Any disputes arising from this Purchase Order shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru (Bangalore), Karnataka, India.
The Buyer reserves the right to modify, suspend, or cancel this Purchase Order in whole or in part with 30 days' written notice. In the event of cancellation, the Seller shall be compensated only for services rendered and materials procured up to the date of cancellation.
The Customs Officer shall report directly to the Assistant Commissioner of Customs, Bangalore Zone, and shall adhere to all operational protocols, duty rosters, and security clearances mandated for customs personnel in India Bangalore.
All documentation, including this Purchase Order, shall be maintained in both English and Kannada as per the bilingual documentation requirements of the Karnataka State Government for offices located in India Bangalore.

3. DELIVERY AND ACCEPTANCE

All goods and services under this Purchase Order shall be delivered to the designated India Bangalore customs facility. Acceptance shall be confirmed in writing by the Buyer's designated inspection officer within 7 working days of delivery. The Customs Officer shall be deemed to have commenced duty upon successful completion of the security clearance and onboarding process at the India Bangalore customs office.
