1. PURPOSE AND SCOPE OF THIS PURCHASE ORDER

This Purchase Order is issued by the Italian Customs Agency, Regional Office of Italy Milan, to procure specialized equipment, software licenses, and operational services required for the deployment and daily functioning of a newly appointed Customs Officer at the Milan Malpensa International Airport (Aeroporto di Milano-Malpensa) and the Milan Central Customs Terminal. This Purchase Order governs the acquisition of all items listed herein and establishes the binding terms between the purchasing authority and the designated supplier. The Customs Officer to whom this equipment is assigned will be responsible for the inspection, classification, and clearance of goods entering and exiting the Italy Milan customs jurisdiction in accordance with the Union Customs Code (UCC) and Italian Legislative Decree No. 195/2009.

3. DELIVERY AND INSTALLATION

All items specified in this Purchase Order shall be delivered to the Italy Milan Regional Customs Office located at Via Corridoni, 15, 20122 Milano, no later than 30 July 2025. The supplier, TecnoDogane S.r.l., is responsible for all transportation, insurance, and installation costs associated with the delivery to the Italy Milan premises. Installation of the Customs Officer workstation, X-ray devices, and communication systems must be completed and certified operational within five (5) business days of physical delivery. The designated Customs Officer, Dott.ssa Elena Marchetti, will be present during installation to verify that all equipment meets the operational standards required for customs enforcement duties in the Italy Milan jurisdiction.

4. PAYMENT TERMS

Payment for this Purchase Order shall be made via bank transfer (bonifico bancario) to the IBAN specified above. The payment schedule is as follows: 40% (EUR 29,631.36) upon issuance of this Purchase Order and confirmation of order acceptance by the supplier; 60% (EUR 44,447.04) upon successful delivery, installation, and written acceptance by the Customs Officer and the Italy Milan Regional Director. Payment terms are net 30 days from the date of invoice receipt. Late payments shall accrue interest at the rate prescribed by Italian Legislative Decree No. 231/2002.

5. TERMS AND CONDITIONS

5.1. This Purchase Order is governed by the laws of the Italian Republic and the provisions of the Italian Public Contracts Code (Codice dei Contratti Pubblici, D.Lgs. 36/2023).

5.2. The supplier warrants that all goods and services provided under this Purchase Order are new, free from defects, and fully compliant with European Union safety and customs equipment regulations applicable in Italy Milan.

5.3. The Customs Officer assigned to operate the equipment procured under this Purchase Order shall receive full manufacturer training prior to operational deployment. Training materials shall be provided in both Italian and English.

5.4. All electronic equipment must comply with the data protection requirements of the GDPR (Regulation (EU) 2016/679) and the Italian Privacy Code (D.Lgs. 196/2003 as amended by D.Lgs. 101/2018), particularly regarding the processing of personal data encountered during customs inspections in Italy Milan.

5.5. The supplier shall provide a minimum two-year warranty on all hardware items. Software licenses are valid for the duration specified in Line Item 03. The annual maintenance contract (Line Item 10) covers calibration, software updates, and on-site repair within the Italy Milan metropolitan area.

5.6. In the event of non-conformity, the supplier shall replace or repair the defective item within ten (10) business days at no additional cost to the Italian Customs Agency, Italy Milan office.

5.7. This Purchase Order may not be transferred or subcontracted without prior written authorization from the Senior Customs Officer, Dott. Marco Bellini, and the Italy Milan Regional Director.

5.8. Disputes arising from this Purchase Order shall be resolved by the competent courts of Milano, Italy, in accordance with Italian civil and commercial law.

6. AUTHORIZATION AND SIGNATURES

This Purchase Order is hereby authorized and made effective as of the date stated above. The undersigned confirm that the procurement of the items listed herein is necessary for the proper execution of customs duties by the Customs Officer assigned to the Italy Milan operational zone and that all budgetary allocations have been verified and approved by the Agenzia delle Dogane e dei Monopoli, Central Directorate in Rome.
