This Purchase Order is issued by the SABC Customs & Trade Compliance Division for the engagement of a qualified Customs Officer to provide on-site customs clearance, trade compliance, and border facilitation services at the O.R. Tambo International Airport cargo terminal and the Johannesburg Central Freight Depot. The appointed Customs Officer shall operate in full compliance with the Customs and Excise Act 91 of 1964, the National Customs and Excise Management System (NCXMS), and all applicable regulations enforced by the South African Revenue Service (SARS) within the Johannesburg metropolitan area of South Africa.

The Customs Officer shall commence duties on 1 July 2025 and shall report to the SABC Customs & Trade Compliance Division office located at 142 Rivonia Road, Sandton, Johannesburg, South Africa. All services under this Purchase Order shall be rendered exclusively within the Johannesburg metropolitan area and its designated border and freight zones. The Customs Officer is required to be physically present at the O.R. Tambo International Airport cargo terminal between 06:00 and 18:00 on all scheduled working days, and at the Johannesburg Central Freight Depot during the audit periods specified in Line Item 02.

5.1 This Purchase Order is governed by the laws of the Republic of South Africa. Any disputes arising from this Purchase Order shall be subject to the jurisdiction of the High Court of South Africa, Johannesburg Division.

5.2 The Customs Officer engaged under this Purchase Order must hold a valid SARS Customs Officer licence (Category B or higher) and must present proof of such licence prior to commencing any duties in Johannesburg, South Africa.

5.3 The vendor, BorderGuard Professional Services (Pty) Ltd, warrants that the Customs Officer shall comply with all anti-corruption provisions of the Public Finance Management Act 1 of 1999 and the Prevention and Combating of Corrupt Activities Act 12 of 2004.

5.4 Payment shall be made within thirty (30) calendar days of receipt of a valid tax invoice. Late payment shall attract interest at the rate prescribed by the Late Payment of Interest to Suppliers Act 15 of 2003.

5.5 The vendor shall maintain a minimum of R5,000,000 professional indemnity insurance for the duration of this Purchase Order. A certificate of insurance must be submitted to the Procuring Entity before the Customs Officer commences work.

5.6 The Procuring Entity reserves the right to terminate this Purchase Order with fourteen (14) days written notice if the Customs Officer fails to meet the performance standards outlined in the service-level agreement annexed hereto.

5.7 All personal data processed by the Customs Officer in the course of duties in Johannesburg, South Africa, shall be handled in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).

This Purchase Order constitutes a binding offer. The vendor's acceptance of this Purchase Order shall be confirmed in writing within five (5) business days of the date of issue. Upon acceptance, the terms herein shall form part of the contractual agreement between the parties for the provision of Customs Officer services in South Africa Johannesburg.
