5. Terms and Conditions
5.1 This Purchase Order shall be governed by and construed in accordance with the laws of England and Wales. All disputes arising from this Purchase Order relating to the engagement of the Customs Officer or the supply of goods in United Kingdom Birmingham shall be subject to the exclusive jurisdiction of the courts of England and Wales.
5.2 The Customs Officer engaged under this Purchase Order must hold a valid HMRC Customs Officer certification, a current DBS (Disclosure and Barring Service) enhanced clearance, and a valid UK driving licence. The Customs Officer shall comply with all codes of conduct set out in the Civil Service Code and HMRC operational guidelines applicable in United Kingdom Birmingham.
5.3 The supplier warrants that all equipment and materials listed in this Purchase Order shall be new, of merchantable quality, and fit for the purpose of Customs Officer operations. Any defective items shall be replaced within fourteen (14) calendar days of written notice.
5.4 Payment shall be made within thirty (30) days of receipt of a valid tax invoice. Late payment shall attract interest at the rate of 4% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
5.5 The Customs Officer shall be required to work a standard 37.5-hour week, Monday to Friday, with on-call availability for emergency customs operations at Birmingham International Airport and the Midlands Freight Terminal. Overtime shall be compensated at 1.5 times the standard hourly rate as stipulated in this Purchase Order.
5.6 This Purchase Order may be terminated by either party with thirty (30) days written notice. In the event of termination, the supplier shall be compensated for all services rendered and goods delivered up to the date of termination.
5.7 All personal data processed under this Purchase Order shall comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. The Customs Officer shall handle all cargo and passenger data in strict accordance with these regulations while operating in United Kingdom Birmingham.
6. Acceptance and Authorisation
