Terms and Conditions
- This Purchase Order is issued by the U.S. Customs and Border Protection office at the Port of Miami, United States Miami, and constitutes a binding agreement upon vendor acceptance. All equipment and services described herein are procured exclusively for the use of Customs Officer personnel assigned to the Miami port inspection division.
- The vendor shall deliver all items to the designated delivery location in United States Miami no later than the required delivery date stated above. Late delivery shall incur a penalty of 1.5% of the total Purchase Order value per calendar day of delay, up to a maximum of 15%.
- All equipment must comply with current U.S. Federal Acquisition Regulation (FAR) standards and applicable DHS security protocols. The vendor warrants that all items are new, unused, and free from defects for a period of no less than two (2) years from the date of installation.
- The Customs Officer training workshop (Line Item 7) must be conducted on-site at the CBP Miami Field Office. The vendor shall provide all training materials, certification documentation, and post-training evaluation forms to the supervising Customs Officer within five (5) business days of workshop completion.
- Payment shall be made via Electronic Funds Transfer (EFT) to the vendor account on file. Invoices must reference this Purchase Order number (CBP-MIA-2025-04872) and be submitted to the CBP Miami Accounts Payable office. Payment is due Net 30 days from the date of valid invoice receipt.
- The vendor shall maintain full insurance coverage, including general liability ($2,000,000 minimum), workers' compensation, and professional liability, for the duration of this Purchase Order and the associated maintenance contract. Certificates of insurance must be provided prior to commencement of work.
- All data collected, stored, or transmitted through equipment procured under this Purchase Order shall remain the exclusive property of U.S. Customs and Border Protection. The vendor shall comply with all applicable federal data security regulations, including FISMA and NIST 800-53 requirements, particularly as they pertain to Customs Officer operational data at the United States Miami port facility.
- This Purchase Order may be modified only by written amendment signed by both the authorized CBP representative and the vendor. No verbal agreements shall alter the terms herein.
- Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the State of Florida and applicable federal statutes. Any disputes shall be resolved in the U.S. District Court for the Southern District of Florida, Miami Division.
