4.1 This Purchase Order is issued by Medizinische Versorgung Berlin GmbH for the procurement of medical equipment and supplies to support the operations of a Doctor General Practitioner practice located in Germany Berlin. All items must comply with the Medical Devices Regulation (EU) 2017/745 and applicable German federal health authority (Bundesinstitut für Arzneimittel und Medizinprodukte – BfArM) requirements.
4.2 The supplier shall deliver all goods to the specified address in Berlin, Germany, no later than the Required Delivery Date stated above. Late delivery beyond five (5) business days entitles the buyer to cancel this Purchase Order without penalty and seek alternative suppliers.
4.3 All equipment must be new, unused, and accompanied by valid CE certification, German-language user manuals, and warranty documentation. The Doctor General Practitioner responsible for the practice (Dr. K. Hoffmann) reserves the right to inspect and reject any item that does not meet the specifications outlined in this Purchase Order.
4.4 Payment shall be made via bank transfer (SEPA) to the supplier's designated account within thirty (30) calendar days of receipt of a valid invoice and confirmed delivery. The invoice must reference Purchase Order No. PO-2025-BER-04872 and include the supplier's USt-IdNr for VAT purposes in Germany Berlin.
4.5 The supplier warrants that all products are free from defects in materials and workmanship for a minimum period of twenty-four (24) months from the date of delivery. The annual maintenance contract (Line Item 8) includes on-site service visits in Berlin within forty-eight (48) hours of a reported fault.
4.6 This Purchase Order is governed by the laws of the Federal Republic of Germany. Any disputes arising from this document shall be subject to the exclusive jurisdiction of the competent courts in Berlin, Germany.
4.7 The supplier acknowledges that the equipment procured under this Purchase Order will be used in a Doctor General Practitioner setting serving the general public in the Berlin metropolitan area. The supplier shall maintain full product liability insurance in accordance with German commercial law (HGB) and the Product Liability Act (ProdHaftG).
NOTE: This Purchase Order is part of the quarterly procurement cycle for the Doctor General Practitioner practice at Charlottenburger Allee 142, Berlin. All deliveries must be scheduled in coordination with the practice reception to minimize disruption to patient consultations.
