- Delivery and Commencement: The Education Administrator shall report for duty at the designated office in Bangladesh Dhaka within 15 working days from the date of acceptance of this Purchase Order. All physical items (workstation, printed materials) shall be delivered to the Education Administrator's office at Motijheel C/A, Dhaka-1000, within 30 calendar days.
- Payment Terms: Payment shall be made in three equal installments: 40% upon successful onboarding and commencement of duties by the Education Administrator, 30% upon completion of the first six-month performance review, and 30% upon successful completion of the 12-month contract period. All payments shall be processed through the Government of Bangladesh's electronic payment system (e-Procurement) in Bangladeshi Taka (BDT).
- Performance Standards: The Education Administrator shall adhere to the performance indicators established by the Dhaka Divisional Education Board. Quarterly performance reviews shall be conducted by the Deputy Education Administrator in Bangladesh Dhaka. Failure to meet minimum performance thresholds for two consecutive quarters may result in termination of this Purchase Order with 30 days' written notice.
- Compliance: The Education Administrator shall comply with all applicable laws of Bangladesh, including the Bangladesh Labour Act 2006, the National Education Policy 2010, and all directives issued by the Ministry of Education. The supplier shall ensure that all services rendered are free from any conflict of interest.
- Confidentiality: The Education Administrator shall maintain strict confidentiality regarding student records, institutional data, and government policy documents accessed during the course of duties in Bangladesh Dhaka. A non-disclosure agreement shall be executed prior to commencement.
- Warranty and Support: All hardware items procured under this Purchase Order shall carry a minimum 12-month manufacturer's warranty. The supplier shall provide technical support and replacement services for any defective items within 7 working days of notification.
- Dispute Resolution: Any disputes arising from this Purchase Order shall be resolved through amicable negotiation. If unresolved within 30 days, the matter shall be referred to the appropriate court of competent jurisdiction in Dhaka, Bangladesh, in accordance with the Code of Civil Procedure 1908.
- Force Majeure: Neither party shall be liable for failure to perform obligations under this Purchase Order due to natural disasters, government-imposed lockdowns, or other events beyond reasonable control, as may occur in Bangladesh Dhaka or elsewhere in the country.
This Purchase Order is issued under the authority of the Education Administrator, Dhaka Division, and is binding upon acceptance by the supplier. The supplier's acceptance of this Purchase Order constitutes full agreement to all terms, conditions, and specifications outlined herein. The Education Administrator's office in Bangladesh Dhaka reserves the right to modify, suspend, or cancel this Purchase Order in accordance with the Government Procurement Rules 2009.
