- This Purchase Order constitutes a binding agreement between the New York City Department of Education and Meridian Educational Staffing Solutions, LLC for the provision of an Education Administrator to serve within the jurisdiction of United States New York City. All terms herein shall be governed by the laws of the State of New York and applicable federal statutes.
- The Education Administrator shall report directly to the Deputy Chancellor of Human Resources and shall perform all duties consistent with the NYSED Administrative License (Level 1 or Level 2) as required for the position. The candidate must hold a valid New York State administrative certification and a minimum of five (5) years of progressive educational leadership experience within a public school system.
- All services rendered under this Purchase Order shall be performed within the geographic boundaries of United States New York City, including but not limited to the five boroughs of Manhattan, Brooklyn, Queens, The Bronx, and Staten Island. The Education Administrator shall maintain a primary office at the designated district location in Manhattan, New York, NY 10013.
- Payment shall be processed via electronic funds transfer (EFT) to the vendor's designated account within thirty (30) calendar days of receipt of a valid invoice. Late payments shall accrue interest at a rate of 1.5% per month in accordance with New York State procurement regulations.
- The vendor warrants that the Education Administrator shall have passed all required background checks, including the New York State Office of Children and Family Services (OCFS) fingerprint clearance, the FBI criminal history check, and the New York City Office of the Chief Medical Examiner's registry screening, as mandated for all educational personnel in United States New York City.
- This Purchase Order may be terminated by either party with sixty (60) days written notice. In the event of termination for cause, the Education Administrator shall be subject to the disciplinary procedures outlined in the New York City Civil Service Law and the applicable collective bargaining agreements.
- All records, student data, and confidential information handled by the Education Administrator shall be maintained in strict compliance with the Family Educational Rights and Privacy Act (FERPA), New York State Education Law, and all United States New York City municipal data protection ordinances.
- Any disputes arising from this Purchase Order shall be resolved through binding arbitration in United States New York City in accordance with the rules of the American Arbitration Association. The prevailing party shall be entitled to recover reasonable attorney's fees and costs.
- This Purchase Order is subject to the availability of appropriated funds. In the event of a budget reduction or legislative appropriation change, the New York City Department of Education reserves the right to modify or cancel this order with appropriate notice to the vendor.
