Payment against this Purchase Order shall be made in accordance with the following schedule. All payments are denominated in Australian Dollars (AUD) and shall be remitted via electronic funds transfer (EFT) to the supplier's nominated bank account in Australia Sydney. The Electrical Engineer services shall be invoiced monthly in arrears, with payment due within 30 calendar days of receipt of a valid tax invoice. A 15% retention shall be withheld from each monthly invoice until final completion and acceptance of all deliverables. The total value of this Purchase Order is AUD 683,650.00 inclusive of GST.
- Qualification Requirements: The Electrical Engineer engaged under this Purchase Order must hold a minimum of a Bachelor of Engineering (Electrical) degree from an Australian university, be a registered professional engineer with Engineers Australia, and hold a valid NSW Electrical Contractor Licence (Class A) or equivalent. A minimum of 8 years of post-qualification experience in large-scale infrastructure projects in Australia Sydney is required.
- Compliance and Standards: All work performed by the Electrical Engineer shall comply with the Australian Standards, the Electrical Safety Act 2002 (NSW), the Building and Development Certificate Act 1992 (NSW), and all applicable regulations of the NSW Electrical Safety Authority. The Electrical Engineer shall ensure all designs and installations meet the requirements of AS/NZS 3000:2018, AS/NZS 3008:2017, and AS/NZS 3012:2018.
- Insurance: The supplier shall maintain, at its own cost, a minimum of AUD 20,000,000 in professional indemnity insurance and AUD 20,000,000 in public liability insurance, with Harbour City Infrastructure Pty Ltd named as an additional insured. Certificates of insurance shall be provided prior to commencement of services under this Purchase Order.
- Work Location: All services under this Purchase Order shall be performed primarily in Australia Sydney, with the Electrical Engineer required to be physically present at project sites within the Sydney metropolitan area as specified in the project schedule. Travel to and from sites within Australia Sydney is included in the rates specified above.
- Confidentiality: The Electrical Engineer shall treat all project documentation, design files, and operational data as strictly confidential. This obligation survives the termination of this Purchase Order for a period of five (5) years.
- Termination: Either party may terminate this Purchase Order by providing 30 days' written notice. In the event of termination, the Electrical Engineer shall be compensated for all services rendered up to the date of termination, less applicable retention.
- Dispute Resolution: Any disputes arising from this Purchase Order shall be resolved in accordance with the Civil and Administrative Tribunal Act 2013 (NSW) or, where the amount in dispute exceeds AUD 1,000,000, in the Supreme Court of New South Wales, Australia Sydney.
- Health and Safety: The Electrical Engineer shall comply with the Work Health and Safety Act 2011 (NSW) and all site-specific safety management plans. A valid White Card and appropriate electrical safety training (including arc flash awareness) must be current prior to commencing on-site work in Australia Sydney.
