1. Description of Services – Environmental Engineer Engagement

This Purchase Order is issued by Green Earth Consultancy Ltd., headquartered in Bangladesh Dhaka, to formally engage the services of a qualified Environmental Engineer and associated technical team for the execution of environmental impact assessment, compliance monitoring, and remediation planning activities within the Dhaka metropolitan area. The Environmental Engineer shall operate in full compliance with the Bangladesh Environment Conservation Act, 1995 (amended 2000), the rules promulgated under the Department of Environment (DoE) of the Government of the People's Republic of Bangladesh, and all applicable municipal regulations of the Dhaka North City Corporation (DNCC) and Dhaka South City Corporation (DSCC).

2. Scope and Qualification Requirements for the Environmental Engineer

The Environmental Engineer engaged under this Purchase Order must hold a minimum of a Bachelor's degree in Environmental Engineering, Civil Engineering (Environmental specialization), or a closely related discipline from a university accredited by the University Grants Commission (UGC) of Bangladesh. A Master's degree or professional certification (e.g., from the Bangladesh Institute of Planners or the Institution of Engineers, Bangladesh) is preferred. The Environmental Engineer must possess a valid professional license issued by the Institution of Engineers, Bangladesh, and demonstrate a minimum of ten (10) years of progressive experience in environmental consulting, EIA preparation, and regulatory compliance within Bangladesh Dhaka or other major urban centers in Bangladesh. All fieldwork, laboratory coordination, and report submissions shall be conducted within the Bangladesh Dhaka metropolitan area unless otherwise approved in writing by the buyer.

3. Terms and Conditions

This Purchase Order constitutes a binding agreement between the Buyer and the Supplier upon signature by both parties. All services shall be rendered in accordance with the specifications outlined herein and applicable laws of the People's Republic of Bangladesh.
The Environmental Engineer and all supporting personnel shall be subject to the buyer's site safety protocols and must comply with all occupational health and safety regulations enforced by the Bangladesh Labour Act, 2006, and the Bangladesh Environment Conservation Rules, 1997.
Payment shall be made via bank transfer to the Supplier's designated account in Bangladesh Dhaka within thirty (30) calendar days of receipt of a valid tax invoice. Late payments shall attract interest at the rate of 1.5% per month as per Bangladesh Bank guidelines.
The Supplier shall provide a performance security in the form of a Bank Guarantee for 10% of the total Purchase Order value, issued by a scheduled bank operating in Bangladesh Dhaka, valid for the entire contract duration plus sixty (60) days.
All deliverables, including EIA reports, monitoring data, compliance certificates, and training materials, shall be submitted in both English and Bangla (Bengali) languages to ensure accessibility for municipal authorities in Bangladesh Dhaka.
The Environmental Engineer shall maintain full confidentiality of all proprietary data, industrial processes, and site information obtained during the course of this engagement. A Non-Disclosure Agreement (NDA) shall be executed prior to commencement of work.
Either party may terminate this Purchase Order with thirty (30) days' written notice in the event of material breach, force majeure, or insolvency. Upon termination, the Supplier shall be compensated for all services rendered up to the date of termination.
All disputes arising under this Purchase Order shall be resolved through arbitration in Bangladesh Dhaka in accordance with the Arbitration Act, 2001 of Bangladesh. The seat of arbitration shall be Dhaka, and the language of arbitration shall be English.
The Supplier shall indemnify and hold harmless the Buyer against any claims, damages, or liabilities arising from the negligence, misconduct, or non-compliance of the Environmental Engineer or any personnel deployed under this contract.
This Purchase Order is governed by and shall be construed in accordance with the laws of the People's Republic of Bangladesh. The jurisdiction of the courts in Bangladesh Dhaka shall be exclusive for any legal proceedings not resolved through arbitration.

4. Commencement and Delivery Schedule

Work under this Purchase Order shall commence within seven (7) calendar days of the date of acceptance by the Supplier. The Environmental Engineer shall report to the Buyer's project office located at House 42, Road 11, Banani, Bangladesh Dhaka 1213, on the first day of engagement. All interim and final deliverables shall be submitted to the Buyer's designated project manager in Bangladesh Dhaka within the timelines specified in Section 1 of this document.
