3. SCOPE OF PROCUREMENT – FIREFIGHTER OPERATIONS, BUENOS AIRES

This Purchase Order is issued by the Firefighter Division of the Buenos Aires Municipal Government to procure specialized firefighter equipment, protective gear, and operational support services required to maintain and enhance the emergency response capabilities of the Cuerpo de Bomberos de la Ciudad de Buenos Aires. All items listed below are intended for use by active-duty firefighters stationed across the 15 communes (comunas) of the City of Buenos Aires, Argentina. 5. TERMS AND CONDITIONS
  1. Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the Argentine Republic, specifically the City of Buenos Aires public procurement regulations and Ley 27.437. Any disputes shall be resolved in the competent courts of the City of Buenos Aires, Argentina.
  2. Delivery: All firefighter equipment shall be delivered to the Buenos Aires Firefighter Central Depot (Depósito Central de Bomberos), Av. 9 de Julio 1000, Buenos Aires, Argentina, no later than 30 September 2025. Delivery shall be DDP (Delivered Duty Paid) per Incoterms 2020.
  3. Quality Standards: All firefighter equipment must comply with NFPA standards (NFPA 1851, NFPA 1971, NFPA 1981), EN 469, and Argentine IRAM standards. The vendor shall provide certificates of conformity for each item delivered to the Firefighter Division in Buenos Aires.
  4. Warranty: The vendor shall provide a minimum 3-year warranty on all firefighter equipment, 5-year warranty on rescue vehicles, and 2-year warranty on electronic devices. Warranty service shall be performed at the vendor's Buenos Aires facility or on-site as required by the Firefighter Division.
  5. Payment: Payment shall be made within 45 calendar days of receipt of a valid invoice and confirmed delivery/acceptance of goods by the Firefighter Division. Payment shall be made via bank transfer to the vendor's account in Argentina. Invoices must include CUIT, CBU/CVU, and reference this Purchase Order number PO-BA-FF-2025-04782.
  6. Inspection and Acceptance: The Firefighter Division of Buenos Aires reserves the right to inspect all delivered equipment prior to acceptance. Non-conforming items shall be replaced or repaired at the vendor's sole expense within 15 business days.
  7. Training: The vendor shall provide on-site training for Buenos Aires firefighters on the operation, maintenance, and emergency procedures of all delivered equipment. Training sessions shall be conducted in Spanish at the Escuela de Bomberos in Buenos Aires.
  8. Confidentiality: All operational details, deployment locations, and firefighter personnel information related to this Purchase Order shall be treated as confidential by the vendor in accordance with Argentine data protection law (Ley 25.326).
  9. Force Majeure: Neither party shall be liable for delays caused by events beyond reasonable control, including but not limited to natural disasters, government sanctions, or civil unrest affecting Buenos Aires, Argentina.
  10. Anti-Corruption: The vendor warrants that no bribe, kickback, or improper payment has been made in connection with this Purchase Order, in compliance with Argentine anti-corruption legislation and the City of Buenos Aires procurement integrity code.
NOTE: This Purchase Order is subject to prior approval by the Secretaría de Hacienda of the City of Buenos Aires and the Comptroller General (Contraloría General de la Ciudad de Buenos Aires).
